BETWEEN WILLIAM WELLS, residing at Bay Haven at Southold, Town of
Southold, Suffolk County, New York,
party of the first para and DOROTHY S. 'rlARNECKE, residing at 92 South Clinton
Avenue, Bay Shore, Suffolk County, New York,

WLTNESSEPH,that the party of the first part,in consideration of

' lawful money of the United States,and other good and valuable consideration paid
by the party of the second part,does hereby grant and relea.,e unto the party of the second part,the heirs or
successors and assigns of the party of the second pad forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
> lying and being the at Bayview, near Southold, in the Town of Southold,
County of Suffolk and State of New York, known and designated as lot
number thirty-nine (39) on a certain map entitled "Bay Haven at
Southold, Suffolk County, New York," surveyed December 10, 1958, by
Otto W. Van Tuyl & Son, Licensed Surveyors, Greenport, N. Y., and
filed in the Office of the Clerk of Suffolk County on the 22nd day
of January, 1959, as Map No. 2910.
_ TOGETHER with a right of way over "Bay Haven Lane,"
"Watersedge Way," "Gin Lane," and "Mid Way" as shown on said map, and
the right, in common with other owners of the lots shown on said map
to the use of the "Community Beach" as designated on said map.
RESERVING NEVERTHELESS unto the party of the first part,
his heirs, administrators, executors and assi me, the fee to the said
"Bay Haven Lane," "Waters, executors
Way," "Gin Lane'' and "Mid Way," and to
t the "Com=ity Beach" and all franchise rights therein and the right
O of dedication to the Southold Bay Haven Property Owners Association,
Inc., or to the proper governmental agency for the use thereby and

i° SUBJECT to the provisions of the declaration recorded by
✓ the party of the first part on February 10, 1959, in the Suffolk
:w County Clerk's Office in Liber 4585 at page 346.
aThe party of the second part agrees for herself, her
heirs, executors, administrators and assigns, that she will join the
Southold Bay Haven Property Owners Association, Inc., and will abide
by the rules and regulations of said association as set forth in the
by-laws thereof.
The conveyance hereunder is subject to a certain mortgage
executed by Willism Wells as mortgagor to Southold Savings Bank as
mortgagee, which mortgage is dated November 26, 1965, and was recorded
on December 7, 1965 in the Office of the Clerk of the County of
Suffolk, in Liber 4A24 of mortgages at Page 42, and on which mortgage
there is now due the sum of $17,357.84 with interest thereon at the
rate of 5i% per annum from the date hereof, and that the grantee
hereby assumes and covenants to pay such mortgage debt and interest
as part of the consideration for this conveyance.
