In the Matter of the Petition of the COUNTY OF SUFFOLK for the purpose of acquiring the real properties for County Park Purposes adjacent to File No. 141944 Goldsmith Inlet, Town of Southold, RECEIPT AND RELEASE Suffolk County, New York. Re: MAP No. 12 WHEREAS, pursuant to the provisions of the Suffolk County Improvement Act the above entitled proceeding was duly instituted by an Order of the Supreme Court which was duly filed in the Office of the County Clerk of Suffolk County on the 2nd day of November , 196 6 , and that thereupon title in fee simple to the property to be acquired in said proceeding became vested in the County of Suffolk, New York, and the proceeding continued for the purpose of determining the compensation to be made to the owners of the real property to be acquired in this proceeding is to be ascertained by the 10 Court without a jury, and CV 414WHEREAS, immediately prior to the vesting of title fs aforesaid in the said County of Suffolk x ►-� ROSALIND CASE NEZELL of Cutehogue, Now York owned the parcel of property acquired as aforesaid and designated in said proceeding 4f: as Map No. 12 which said parcel of property is more particularly described as g. follows: v LL a ALL that piece or parcel of land situate in the Town of Southold, County of Suffolk, State of New York, for park purposes, and described as follows: BEGINNING at a point on the division line between the lands of Rosalind C. Newell, reputed owner on the south, and the lands of the S. F. Overton Estate, reputed owner on the north, at its intersection with the westerly boundary of the existing Sound View Avenue; thence along the said westerly boundary the following two courses and distances: (1) S 100 51' 20l, W, 606. 72 feet, and (2) S 230 041 20t, W, 239. 18 feet to a point on the northerly boundary of the existing Peconic Mill Lane; thence along the last mentioned boundary, the following two courses and distances: (1) N 820 281 201, W, 41. 60 feet, and (2) N 780 291 200 W, 168. 56 feet to a point on the division line between the lands of Rosalind C. Newell, reputed owner on the east and Lot No. 37 as shown on a map entitled "Map of Bailey Park" and filed in the office of the Cleric of Suffolk County under File No. 1097; thence N 110 051 501, W, along the last mentioned division line 100. 00 feet to a point on the average high water line of Goldsmith's (Peconic) Inlet; thence generally northerly along the said high water line as it winds and turns to a point on the first mentioned division line, the tie line between the points on said high water line bding the following six courses and distances: (1) N 740 131 0011 E. 46. 07 feet; (2) N 320 031 1011 E, 126. 24 feet; (3) N 14043' 3011 W, 161. 30 feet; (4) IN 370 22, 00,f w, 207. 61 feet; (5) S 840 251 001, W, 133. 63 fent: and (6) N 340 49' 501, E, 604. 94 feet; thence S 480 261 501, E, along the first mentioned division line 370. 00 feet to the point of beginning; being 7. 31 acres more or less as shown on a map on file in tb.e office of the Commissioner of Public Works of Suffolk County. Goldsmith Inlet (Parcel No. 12); Continued LIBA592 FAA22 and WHEREAS, the said person or persons who owned said parcel of property prior to its acquisition as afore. said by the County of Suffolk desire to compromise and settle the claim for compensation therefor at the sum of $ 55,000,00 , which the said County agreed to pay, NOW, THERtFORE, in consideration of the premises and of the sum of $ 55,000.00 lawful money of the United States, in hand paid to the undersigned, receipt whereof is hereby acknowledged, the undersigned hereby accepts said sum in full compromise and settlement of any and all claims for compensation or damage by reason of the acquisition of said parcel of property by said County, and the ascertainment of compensation or damages by the said Court is hereby waived and the said County of Suffolk is hereby released from any other or further claim for the acquisition of said parcel of property, and the undersigned hereby ratify and confirm the title to said parcel of property acquired by said County as aforesaid.
