In the Matter of the Petition of the COUNTY OF SUFFOLK for the purpose of acquiring the real properties for File No. I41944 County Park Purposes adjacent to Goldsmith Inlet, Town of Southold, RECEIPT AND RELEASE Suffolk County, New York, Re: MAP No. 4 WHEREAS, pursuant to the provisions of the Suffolk County Improvement Act the above entitled proceeding was duly instituted by an Order of the Supreme Court which was duly filed in the Office of the County Clerk of Suffolk County on the 2nd day of February , 1966 , and that thereupon title in fee simple to the property to be acquired in said proceeding became vested in the County of Suffolk, New York, and the proceeding continued for the purpose of determining the compensation to be ffiade to the owners of the real property to be acquired in this proceeding is to be ascertained by the Court without a jury, and WHEREAS, immediately prior to the vesting of title as aforesaid in the said County of Suffolk ANN MARIE & ROBERT NELSON of 34 Rockywood Road, Manhasset, New York L owned the parcel of property acquired as aforesaid and designated in said proceeding as Map No. 4 which said parcel of property is more particularly described as follows: ALL that piece or parcel of land situate in the Town of Southold, County u of Suffolk, State of New York, for park purposes, and described as follows; N BEGINNING at a point on the division line between the lands of Robert .o and Anu Nelson, reputed owners on the north, and the lands of George M. Worth, reputed owner on the south, at its intersection with the existing easterly boundary a of Peconic Mill Lane; thence N 490 55' 501, W, along said boundary 50.00 feet to a point on the division line between the lands of Robert and Ann Nelson, reputed owners on the South, and the lands of Robert Nelson, reputed owner on the north; thence N 400 04- 10--E, along the last mentioned division line 80.00 feet to a point oa the average high water line of Goldsmith's (peconic) Inlet;thence generally southeasterly along the said high water line, a distance of about 51 feet to a point on the first mentioned division line, the tie line between the pointe on said high water line bearing S 370 241 40" E, 51.22 feet;thence S 400 04' 10-1 W, along the first mentioned division line 68.90 feet to the point of beginning; being 0,09 acre more or less, as shown on a map on file in the office of the Commissioner of Public Works of Suffolk County. and WFEREAS, the said person or persons who owned said parcel of pYBp'eY{(y• PACEJIJ `prior to its acquisition as aforesaid by the County.of Suffolk desire to compromise and settle the claim for compensation therefor at the sum of$ 14,900.O9which the said County agreed to pay, NOW, THEREFORE, in consideration of the premises and of the sum of$14,900.00 , lawful money of the United States, in hand paid to the under. signed, receipt whereof is hereby acknowledged, the undersigned hereby accepts said sum in full compromise and settlement of any and all claims for compensation or damage by reason of the acquisition of said parcel of property by said County, and the ascertainment of compensation or damages by the said Court is hereby waived and the said County of Suffolk is hereby released from any other or further claim for the acquisition of said parcel of property, and the undersigned hereby ratify and confirm the title to said parcel of property acquired by said County as aforesaid. As an inducement to said compromise and settlement it is represented and guaranteed by the undersigned that at the time title to said parcel of property vested in said County the undersigned had fee simple title thereto free of any incumbrances or liens or claims of any nature and that no assignment has been xrede of the compensation to be paid by said County for said property. n IN WITNESS WHEREOF, this instrnntl ant is executed this day
