In the Matter of the Petition of the COUNTY OF SUFFOLK for the purpose of acquiring the real properties for County park purposes adjacent to File No. 141944 Goldsmith Inlet, To,of Southold, RECEIPT AND RELEASE Suffolk County, New York. Re: MAP No. 5 WHEREAS, pursuant to the provision, of the Suffolk County Improvement Act the above entitled proceeding was duly instituted by an Order of the Supreme Court which was duly filed in the Office of the County Clerk of Suffolk County on the 2nd day of February , 1966 , and that thereupon title in fee,imple to the property to be acquired in said Proceeding became vested in the County of Suffolk, New York, and the Proceeding continued for the purpose of determining the compensation to be made to the owners of the real property to be acquired in this proceeding is to be ascertained by the Court without a jury, and [� IWHEREAS, immediately Suffolk prior to the vesting of title se aforesaid in the said County of ANN MARIE & ROBERT NELSO11 of 34 Rockyyood Road, Manhasset, New York owned the parcel of property acquired as aforesaid and designated in said proceeding follows: Map No. 5 which said parcel of property is more fallow,: Particularly described as ALL that piece or o of Suffolk, State of New Yoparcel k c orof ark situate in the Town of Southold, County o m P purposes, and described as follows: w c BEGINNING ata point on the division line between the lands of Robert Nelson, reputed movers ct the south, and Ann M, Nelson, reputed owner on the north, at its intersection with the easterly boundary of the Mill Lane; thence N 40 04' IO" existing peceaic E, along the said divis to the average high water line of Goldsmith's (pecanic) Inlet; thence geneion line 70.00 feet, reputed t to a c rally southeasterly along the said high water line a distance of about 51 fee point on the division line between the lands of Robert Nelson on the north, and the lands of Robert and Ann Nelson, owner reputed owners on the south; the tie line between the points on said high water line bearing S 610 14' 301- E, 50.99 feet; thence 5'400 04' IO" W, along the last mentioned division line, 80,00 feet to a point en the said easterly boundary of Peconic Mill Lane; thence N 490 55' 50., W, along said boundary 50.00 feet to the Point of beginning; being 0,09 acre more or less as shown on a map on file in the office of the Commissioner of public Works of Suffolk County. LIBER6287 PAGE515 n nd WHEREAS, the said person or persona who owned said parcel of property • prior to its acquisition as aforesaid by the County of Suffolk desire to compromise and settle the claim for compensation therefor at the sum of$ 4.,800,00 , which the said County agreed to pay, NOW, THEREFORE, in consideration of the premises and of the sum of$4.,800.00 , lawful money of the United States, in hand paid to the under- signed, receipt whereof is hereby acknowledged, the undersigned hereby accepts said sum in full compromise and settlement of any and all claims for compensation or damage by reason of the acquisition of said parcel of property by said County, and the ascertainment of compensation or damages by the said Court is hereby waived and the said County of Suffolk is hereby released from any other or further claim for the acquisition of said parcel of property, and the undersigned hereby ratify and confirm the title to said parcel of property acquired by said County as aforesaid. As an inducement to said compromise and settlement it is represented and guaranteed by the undersigned that at the time title to said parcel of property vested in said County the undersigned had fee simple title thereto free of any incumbrances or liens or claims of any nature and that no assignment has been node of the compensation to be paid by said County for said property.
