THIS INDENTURE made this 84day ofy-1966, between Helmut Hass, 4 residing at Southold, New York, someti�nes(�.lso known as,Helmuth Hass, party of the first part, and William H. Fiedler and Dolores Elyse Fiedler,his � .�. dughter, both residing at 59-31 Linden Street, Ridgewood, New York, party k.... of the second part, as joint tenants and not as tenants in common, as WITNESSETH, that the party of the first part, in consideration of$30 and other valuable consideration paid by the party of the second part, does herebyrant and release unto the g party of the second part, the heirs or ,p successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land situate, lying and being at ' Arshamomaque, Town of Southold, County of Suffolk and State of New York, bounded and described as follows; BEGINNING at a point on the easterly line of Beverly Road where the same is intersected by the midline of Old Cove Boulevard (said point of beginning being distant 90.18 feet on a course south 31°40'50" east from the intersec- tion formed by said easterly line of Beverly Road with the southerly line of the North Road (County Road 27), and running thence along the easterly line of Beverly Road, south 31`40'50" east, 100.68 feet to a point;thence south 51°19110"west, 118 feet, more or less, along land of Bowman through a concrete bulkhead to the ordinary high water line of Old Cove, an arm of Arshamomaque Pond; thence in a general northwesterly direction, along the ordinar y high water mark of Old Cove,about 23 feet to a point; thence along other land of the party of the first part, north 24°32'20"west, 105 feet, more or less, to a point in the midline of Old Cove Boulevard;thence north 61"59110" east, 118.79 feet along said midline of Old Cove Boulevard, to the point or place d beginning. TOGETHER with the right to pass and repass for all ordinary purposes over the northerly half of Old Cove Boulevard adjacent to the premises and over Beverly Road from the northeasterly corner of the premises northerly to the North Road and from the southeasterly corner of the premises southerly to Arshamomaque Pond, and to an easement for the purpose of laying, re- laying, repairing, operating, and maintaining a water line from the premises ` across Old Cove Boulevard and other property of the seller (party of the first part herein) to the North Road, where such a line is now laid(and on two feet on either side thereof) until such time as such water service is brought to the premises over Beverly Road or Old Cove Boulevard. SUBJECT to covenants, restrictions, easements, agreements, reservations, and zoning regulations of record, if any. The easterly 20 feet of said premises, comprising the entire width of a part of the length of Beverly Road and the northerly 10 feet thereof, comprising the southerly one-half of a part of the length of Old Cove Boulevard are SUBJECT to{1) the rights of the party of the first part, his heirs and assigns, and others, to pass and repass for all ordinary purposes of ingress - - and egress and passage over, (2) the right of public utilities to run gas, water, telephone, and other communication, and electric power lines over, under, on, along, and through them, and (3) the right of the party of the first part to grant to others and to public utilities rights of way for passage for ingress and egress and for utilities. Said premises are furthermore SUBJECT to the right of the party of the first part, his heirs and assigns, to lay, relay, repair, operate, and maintain water lines for the purpose of servicing said premises and other adjacent lots with a public water supply where such line(s) is presently located, and to an easement for such purposes along such lines and two feet on either side thereof. The Party of the first part represents that said lines are located underground approximately as shown on the survey annexed hereto and made a part hereof, and that on any occasion when it is necessary for the surface to be disturbed to relay and /or repair such lines the same shall be re- stored to its previous condition, within a reasonable time. BEING and intended to be part of the premises conveyed to the party of the first part by two deeds, to wit; 1) from William A. Richmond and Margaret W. Richmond, his wife, dated October 4, 1953, recorded October 20, 1953, liber 3598 of conveyances, page 291, in the Suffolk county clerk's office, and (2) from William A. Richmond and Margaret W. Richmond, his wife, dated May 22, 1956, recorded May 25, 1956, liber 4118 of conveyances, page 486, in said county clerk's office.
