ALL that certain plot,piece or parcel of land, situate,
IyingandbeingjK`W at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:-
BEGINNING at a point marked by a monument formed by the intersection
of the southeasterly coiner of land of Edith B. Mailler with the westerly
line of land of Charles 0. Christensen and wife with the northeasterly
corner of the premises herein described; running thence in a southerly
direction along the westerly line of said land of Charles 0. Christensen
and wife, South 5 degrees 51 minutes 10 seconds Nest, a distance of
163.52 feet to the northerly line of a proposed 50 foot highway to be
known as Custer Avonuo; running thence along said northerly line of said
proposed 50 foot highway to be known as Custer Avenue, North 77 degrees
33 minutes 40 seconds West, a distenco of 1111.94 foot; running thence
North 5 degrees 51 minutes 10 seconds East, a distance of 165.99 feet to
the southerly line of land of Edith B. Mailler; running thence along
said land of Edith B. Mailler, South 84 degrees 39 minutes 30 seconds
East, a distanco of100feet to the point or place of beginning.

TOGETHER with the right to the use, in common with others, of the
proposed 50 foot right of way to be (mown as Custer Avonue extending
from the southeasterly corner of the premises above described and run-
ning westerly to the subdivision known as Fairview Park, the northerly
line of said right of way running North 77 degrees 33 minutes 40 seconds
West, a. distance of 302.10 feet, said right of way being for the purpose
of ingress and egress to and from the public highway (mown as Bennett
Lano and to and from the promises above described, as well as for the
installation, repair, maintenance and replacement of public utility
lines, pipes and conduits on the surface or below the surface or above
the surface of said right of way in suchuannor so as not to interfere
with the surface travel. Reserving, however, to the parties of the first
part, the right to dedicate said private road to the Town of Southold
as a public highway. And the parties of the aocond part by the accept-
once of this deed do hereby release the Town of Southold from all claim
for damages by reason. of change of grade.

TOGETHER with the right to the use, in common with others, of the

easterly from the public highway known as Bennett Iano, th6"northerly
line of said right of way commencing at a point on the easterly line
of Bennett lane (which point is South 9 degrees 40 minutes 40 seconds
West a distance of 353.34 feet from a point marked by a monument at the
intersection of the, easterly line of Bennett Lane with the southerly
lane of Pine Reck Road) and which northerly line extends easterly on
a course.running South 60 degrees 19 minutes 20 seconds East, a distance
of 160.0 feet to the first mentioned right of way, said right of way
being for the purpose of ingress and egress to and from the public high-
way known as Bennett lane and to and from the promises above described,
as well as for the installation, repair, maintenance and replacement or

surface or above the surface of said right of way in such manner so as
not to interfere with the surface travel. Reserving, however, to the
parties of the first part, the right to dedicate said right of way to
the Town of Southold as a public highway. And the parties of the second
part by the acceptance of this deed do hereby release the Town of Southold
from all claims for damages by reason of change of grade.
