WITNESSETH,that the party of the first part,in consideration of

by the part,of the second part,does hereby remise, release and quitclaim unto the party of the second part,

ALL that certain plot piece or panel of land, with the buildings and improvements thereon erected, situate,
lying and beinglMuE at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:-
BEGINNING at a point marked by a monument on the easterly line of
Town Harbor Lane at the westerly porner of the promises heroin described
and the southerly cornor of other land of Cecelia Tynan Brestor; running
thence along the southerly line of said other land of Brostor, North
54 degrees 22 minutes 40 ascends East a distance of 262.26 foot to a
point marked by a monument and land formerly of Carrie C. Overton; run-
ning thence along said land of Overton, South 36 degrees 31 minutes
00 seconds East a distance of 50.95 feet; running thence South 58 do-
grace 28 minutes 50 seconds west a distance of 266.01 feet to the east-
erly line of Town Harbor Lane; running thence along the easterly line
of Town Harbor Lana, North 31 dogrees 31 minutes 10 seconds west a dis-
tance of 32.00 foot to the point or place of boginning.
TOGETHER with all right, title and interest, if any, of the sellor
in and to-Town Harbor Lane in front of and abutting said promisee to
the conter line thereof.
-SUBJECT to any stato of facts a more accurate survey may show pro-
vided the same does not render the title thereto unmarketable.
SUBJECT to the following covenant and restriction:
1. That said promises shall be used solely for residential purposes.
2. The above covenant and restriction may be modified, altered or an-
nulled as to the promises described herein or as to any other neighbor-
ing property now or f armerly owned by the party of the first part at
any time by written agreement by and between the grantor, her distribu=
tees or assigns, and the then owner for the time being of the promises
upon which it is agreed to amend, alter or annul such covenant and re-
striction and such agreement shall be effectual to modify, alter or

nant running with the land and be binding upon the successors, assigns;
distributees, legal repres antatives, executors or administratorsofthe
respective parties hereto until January let, 1977, when said covenant

Being and intended to be the -same premises conveyed by Alice Louise
Miller, the grantor herein, to Cecelia Tynan Brester, the grantee here-
in, biv deed dated September 22, 1956 and.recorded in the Suffolk County
Clork a Office on.October 18, 1956 in Liber 4199 of Deeds at page 198,
and this deed is given for the sole purpose of removing restriction no.
- 2 as set forth.in said deed, it being the intention of the parties here-
to that the aforesaid restriction no. 2 shall no longer be In force and
effect and that no setbeok shall be required for any structure, other
than what may be required in order to comply with existing zoning or-
dinances. _
