Russell to execute the Data Sharinl! MOU Al!reement between the Town of South old and the New York State Dept, of Motor Vehicles in connection with rel!istration information inquiries involving Justice Court violations, subject to the approval of thc Town Attorney. Edwards, Councilman AYES: Evans, Wickham, Ross, Edwards, Russell, Krupski Jr. B..". .... . , New York State Department of Motor Vehicles DATA SHARING MOU Town of Southold Town of Southold , requests information pertaining to , hereinafter referred to as Reqistration Information Inquiries and the New York State department of Motor Vehicles (hereinafter referred to as DMV) agrees to share such data. Therefore, Town of Southold and DMV set forth their mutual understanding as follows: Town of Southoid acknowledges that 18 U.s.c. Sec. 2721 et seq. (also known as the "Federal Driver's Privacy Protection Act" or "DPPA") permits government agencies, and private persons or entities acting on behalf of a government agency, to have access to personal information from Motor Vehicles records for use in carrying out agency functions. Town of Southold agrees to fully comply with all provisions of the DPPA. If Town of Southold shares personal information obtained from DMV records, Town of Southold wili obtain an agreement from the recipient for each time such data is shared. The agreement wiil identify the recipient and specify the recipient's DPPA Permissible Use for the information. Town of Southold will retain the agreement obtained from the recipient for FIVE YEARS after the date on which DMV records are shared with the recipient. Such agreement wili be made avaiiable to DMV staff for audit purposes. If Town of Southold , or any subsequent recipient, discovers that an unauthorized party has acquired or used DMV data, it will notify DMV's Audit Services Unit within one business day. Notification should be sent to: Edward Wade DMV Audit Services 6 Empire State Plaza, Room 321A Albany, NY 12228 Any recipient of the data will defend, hold harmiess, and indemnify DMV and its empioyees or agents from all claims actions, damages, or losses which may be brought or alleged against them for the recipient's negligent, Improper or unauthorized use or dissemination of information provided by DMV. DMV will not be responsible for any omissions or errors in the data furnished to any recipient. This agreement will continue until terminated, or until it is replaced by a successor MOU as provided herein. The Commissioner of the Department of Motor Vehicles, or Town of Southold may terminate this agreement at his/her discretion. Additionai terms of this agreement, including the specific data being shared, are as follows: Batch Registration Inquiries: Town of Southold will submit records containing plate numbers and optional registration classes. DMV will then provide the following current registration information: name, address, date of birth, gender, vehicle description, expiration date and current registration status (expired, suspended, etc.). Scofflaw and Suspension: Town of Southold will submit records containing jurisdiction code, plate number, registration class, name, case number, and the effective dates of the scofflaw or the suspension or the compliance date of suspension clearance. DMV will add the scofflaw or suspension information to the registration record or clear suspension information from the registration record, and then will provide the following current registration information: name, address, date of birth, gender, vehicle description, expiration date, effective date of the scofflaw/suspension, and status of the registration record.
