SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 19,515 sq. ft. parcel has 70 ft. frontage along Pine Tree Road and 30.03 ft. frontage along Bittersweet Lane in Cutchogue. The property is improved with a two-story frame residence and accessory storage shed, as shown on the September 27, 2004 survey prepared by Stanley J. Isaksen Jr. BASIS OF APPLICATION: Building Department's September 14, 2004 Notice of Disapproval, citing Sections 100-242A and 100-2448, in its denial of a building permit to construct a proposed dormer above the first floor, disapproved for the reason that the addition will be an increase in the degree of nonconformance with a front yard setback of less than 35 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story dormer on their home which will be approximately 24 feet from the front property line at Bittersweet Lane, instead of the 35 ft. code requirement. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property has two front yards facing two streets. The dormer is proposed on the north side at the closer front setback adjacent to Bittersweet Lane. Mrs. Scoggin indicated that the roof of their home was leaking, and since they would need to replace the roof, they decided to increase the second story by creating a dormer. Page 2—October 21, 2004 File No. 5622—L. and S.Scoggin CTM Parcel 104-2-8 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house exists with an 8.5 ft. setback to the front lot line, and the dormer addition is proposed with a greater setback than exists on the first floor area. 3. The variance granted herein is not substantial. The existing dwelling is nonconforming with a front yard setback at only 8.5 feet, and the dormer is proposed over the first floor area with a greater front yard setback. 4. The difficulty was not self-created. The house has existed in this location for more than 44 years, and the nonconforming first floor area is not increased or expanded. 5. No evidence has been submitted to suggest that a variance in this residential community consisting of long, narrow lots will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dormer addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by -- - Member-Dinizio,and-duly-carried,-to-- - -- - - - — — -- -- ---- - ----- - - GRANT the variance as applied for, as shown on the September 27, 2004 survey prepared by Stanley J. Isaksen, Jr., the sketched area shown on the August 24, 1981 survey prepared by Roderick VanTuyl, L.S., and architectural diagrams prepared by Ural Talgat dated 9/3/04. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva hairwoman), Goehringer, and Dinizio. Absent during this resolution were Members Orlando andTJora. Thises?1 was duly adopted (3-0). 6 -) A Ruth D. Pursuant to the ZBA's interpretation in Walz (#5309), such additions and alterations will thus constitute an increase in the degree of non-conformance. Therefore, the proposed addition is not permitted pursuant to Article III Section 100-244 which states that nonconforming lots measuring less than 20,000 square feet in total size require a front yard setback of 35' (thirty five feet). Patricia Conklin, Permit Examiner CC: file, Z.B.A. Note to Applicant: Any change or deviation to the above referenced application may require additional review from the Southold Town Building Department. Swimming Pools: [ ] All heated swimming pools must have an on/off heater switch and require a cover unless over 20% of the heating energy is from non-depletable sources. Pool pumps require a time clock. Heating and Cooling Piping Insulation: [ ] HVAC piping conveying fluids above 105 T or chilled fluids below 55 °F must be insulated to the levels in Table 2.
