THIS INDENTURE, made the 15th day of January nineteen hundred and seventy
BETWEEN VIOLA KAY SMITH, residing at Maple Avenue at Southold,
in the Town of Southold, Suffolk County, New York,

Helen S. Joost to Viola May Smith by deed dated October 25, 1954,
and recorded in the Suffolk County Clerk' s 'Office on October 28,
1951 , in Liber 3782 of deeds at page 389.
SUBJECT to covenants , reservations and restrictions of
record.
PARCEL 7VO : ALL that certain tract or parcel of land, situate,
lying, and being at Southold, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:-

of land of Diefenbacher, which point is the northeasterly corner'

above described, South 16 degrees 6 minutes 30 seconds East, 70
feet to a monument ; running thencestill along Parcel One above
described, South 72 degrees 32 minutes 30 seconds West, 88.57
feet to a monument ; running thence along lands now or formerly
of Downs , North 16 degrees 1�0 minutes 110 seconds West , 69.88 feet
to a monument; running thence along land of Diefenbacher, North
72 degrees 28 minutes 30 seconds East, 89. 26 feet to the point or
place of BEGli1N1NG.
Reing and intended to be the same premises conveyed by
Paul L. Diefenbacher to Viola May Smith by deed dated December 2,
19580 and recorded December 19, 1958 , in the Suffolk County Clerks
Office in Liber 4562 of deeds at page 502.
SUBJECT to covenants , reservations and restrictions of
record, if any.
The conveyance hereunder is subject to a certain mortgage
executed by Viola May Smith as mortgagor to Southold Savings Bank
as mortgagee, which mortgage is dated February 25, 1955, and was
recorded on February 25, 1955 in the Office of the Clerk of the
County of Suffolk, in liber 2365 of mortgages , at page 531, and on
which mortgage there is now due the sura of $3,605. 79 with interest
thereon at the rate of 5 per annum from December 25, 1969, and
that the grantees hereby assume and covenant to pay such mortgage
debt and interest as part of the consideration for this conveyance.
