TPATRICK F. LEARY and JOAN M. LEARY, his wife, both residing at

WITNESSETH,that the party of the first part, by virtue of the power and authority given in and by said last
will and testament, and in consideration of THIRTEEN THOUSAND
($13.,000.90) dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and bemgaq'gJhC at Southold, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as 'follows :
E BEGINNING at a point on the Westerly side of Town Harbor Lane,
distant 420.45 feet Southerly as measured along the Westerly
side of Town Harbor Lane from the intersection of same with the
Southerly side of L'Hommedieu Lane, which point is also that at
which the Westerly side of Town Harbor Lane is intersected by
the Southerly side of land now or formerly of John and Helen Jer-
nick, and from said point of beginning running thence along the
'Westerly side of Town Harbor Lane South 31 degrees 31 minutes
10 seconds East 60 feet to land now or formerly of Matthew J .
Lyons ; thence along said land of Lyons South 56 degrees 13 minutes
`40 seconds West 179.43 feet; thence along Map of Founder's Estates,
North 26 degrees 39 minutes 20 seconds West 60 feet to said land
of Jernick; thence along land of Jernick North 56 degrees 05
minutes 20 seconds East 174.36 feet to the Westerly side of Town
Harbor Lane at the point or place of BEGINNING.

TOGETHER with all right,title and interest if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the centerlines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said Premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said willor otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law; covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "partiev" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
