"'it o51 L164657 ew 573 THIS INDENTURE,made the A day of October nineteen hundred and sixty—nine, BETWEEN BLEECKER CONSTRUCTICK COMPANY, INC . , a domestic corporation having its principal office at Ridge Road, Laurel Hollow, Syosset , Nassau County, New York, party of the first part, and MARTINO HRONCICH and CARMELA HRCNCICH, his wife, both residing at 704 Willow Avenue, Hoboken, New Jersey, \ party of the second part, I' �U WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hertby grant and release unto the party of the second part, the heirs ,, Ior successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of ( " f I New York, known and designated as Lot No. 29, on map entitled, "Map of Subdivision Willow Point", Arshamomaque, Town of Southold, Suffolk County, New York, and filed in the Office of the Clerk of t the County of Suffolk on June 16, 1966s as Map No. 4652- TOGETHER with the right in common with others owning lots in this subdivision, to the use of a marina and beach area as shown on said subdivision map. SUBJECT to such regulations and annual assessments as may be pres- cribed by an association of property owners. r SUBJECT to Declaration of Covenants and Restrictions recorded in the Suffolk County Clerk's Office on July 13, 1966 in Liber 5991, cp. 460. SUBJECT to Declaration of Covenants and Restrictions recorded in the Suffolk County Clerk's Office on December 7, 1967 in Liber 6269, ep. 45. SUBJECT to Declaration and Agreement among property owners dated August 7, 1968, recorded in the Suffolk County Clerk' s Office on September 16, 1968, in Liber 6419, cp 194. This conveyance is made in the regular course of business of the party of the first part with the consent of the holders of all out- standing shares of stock. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO IIAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first pant covenants that the party of the first part has not done or Buffeted anything whereby the said -premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will appiv the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party' shall be construed as if it read "parties" whenever the sense of this indenture so requires.
