THIS INDENTURE, made the 26th day of June , nineteen hundred and sixty-nine
BETWEEN THOMAS J. ELAK, residing at Summer Lane, Southold, New York,
party of the first part, and THOMAS J. ELAK and TERRI LEE ELAK, his wife, both residing
at Summer Lane, Southold, New York,
party of the second part,
WITNESSETH,that the party of the first part,to consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town .of Southold, at Bayview, Suffolk County, New York, more
particularly shown and designated as Lot number 23 on Map of Bayside Terrace,
which map was filed in Suffolk County Clerk's Office on March 11, 1953, as Map
#2034•
Together with the right to use, in common with others as determined by the
party of the first part, and only for the benefit of the premises herein
described, for ingress and egress, only, to Goose Creek, a strip of land atCN
Town of Southold, Suffolk County, New York, 20 feet in width bounded
northeasterly about 240 feet by Waterview Drive as it extends northwesterly to
XGC Goose Creek, southeasterly by Waterview Drive, 20 feet, southwesterly by lands
to now or formerly of Eastern Suffolk Realty Inc. about 240 feet, and northwesterly
by Goose Creek.
41': Together with a right of way for ingress and egress andtfor public utilities
over the streets shown on said map, to the nearest public highway.

Being and intended to be the same premises conveyed to the pasty of the first
part by deed dated December 4, 1968, by B. Arthur Thurm and recorded in the
Suffolk County Clerk's office December 26, 1965.

TOGETHER with all right, title and interest, if any, of the party of the firstput of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the �a
and all the elate and rights of the party of the first part in and to said premises; TO HAV AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or sucim9ors and amigm of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first pat#, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be zpplicd first for the purpose of paying the cost of the improvement and will ap+Fly
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
