THIS INDENTURE, made the ~ day of March, Two Thousand BETWEEN ROBERT F. SPITZENBERG and IRENE SPITZENBERG, husband and wife, both residing at 375 Elizabeth Lane, Southold, New York 11971 party of the first part, and ROBERT F. SPITZENBERG, JR., residing at 344 Terry Court, Southold, New York 11971 party of the second part, WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being at Bayview, Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows:- BEGINNING at a point in the northerly comer of the premises herein described; said point being distant South 46 degrees 38 minutes 50 seconds West 330 feet from a point where the southeasterly side of land now or formerly of Colavito intersects the southwesterly side of Main Eayview Road; RUNNING THENCE from said point of beginning South 43 degrees 21 minutes 10 seconds East 197.22 feet; RUNNING THENCE South 25 degrees 16 minutes 10 seconds West 107.39 feet; RUNNING THENCE North 43 degrees 21 minutes 10 seconds West 236.37 feet to the southeasterly side of land now or formerly of Colavito; RUNNING THENCE along said last mentioned land North 46 degrees 38 minutes 50 seconds East 100.00 feet to the point of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Richard W. Gilbfide and Hollye C. Gilbfide dated January 20, '1981, and recorded in the Suffolk County Clerk's Office on January 26, 1981, in Liber 8950 page 3'87. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to Robert F. Spitzenberg and Irene Spitzenberg, the party of the first part. TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and fights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the fight to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
