BARZAC, JR. and LIZA BARZAC, his wife, both residing at 890 Boisseau Avenue, Southold, New York party of the first part, and GIUSEPPE CODAN and ERMINIA CODAN, his wife, both residing at 40-20 Benham Street, Elmhurst, New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the �Q second part, the heirs or successors and assigns of the party of the second part forever, tM ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beinggttAtax at Southold,*\County of Suffolk, and State of New York, bounded and described as follows: 4Wr4 y BEGINNING, at a concrete monument set at the southwesterly corner of the y premises herein described, said point of beginning being distant 850:49 feet easterly (as measured along the northerly side of a 25 foot right-of-way) from the intersection of the southerly line of land now or formerly of John J. Delaney with the easterly side of Boisseau Avenue and from said point of beginning running thence North 2 degrees 30 minutes 10 seconds East 140 feet to a point; _ thence South 81 degrees 55 minutes 50 seconds East a distance of 110 feet to d a point; thence South 2 degrees 30 minutes 10 seconds West a distance of 140 feet to the northerly side of a 25 foot right-of-way; thence along the northerly side of a 25 foot right of way North 81 degrees 55 minutes 50 seconds West a distance of 110 feet to the point or place of beginning. TOGETHER with the right to use the right-of-way (in common with others) over said 25 foot right-of-way from the southeasterly corner of the premises westerly about 960 feet to Boisseau Avenue, said 25 foot right-of-way narrowing to 21. 5 feet where it intersects said Boisseau Avenue. The right to the use of said. right-of-way being for the purpose of ingress and egress to and from the premises above described and to and from Boisseau Avenue and for the installation, maintenance, repair and replacement of public utility lines, wires, conduits and pipes on the surface, below the surface and above the surface of said right-of-way, such installation to be at such location and in such manner as not to interfere with the surface use of the right-of-way. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or"successors"and assigns of the parry of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall he construed as if it read "parties" whenever the sense of this indenture so requires.
