KRUKOWSKI , residing at 416 East 74th Street, New York, N.Y. party of the second part, I WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, situate, -V lying and being i1x1he Bay View, in the Town of Southold, County of Suffolk o & and State of New York, and bounded and described as follows: PARCEL TWO J BEGINNING at a point on the Northwesterly line of a 50 foot private road, hereinafter described 175 feet Southwesterly along said North- westerly line from its intersection with the Southwesterly line of LL Bayview Road, and running thence along said Northwesterly line of said private road, South 25 degrees 16' 10” West 85 feet to land now or formerly of Alfred and Victoria Amante; thence along the Northerly line of said land, North 59 degrees 01' 00" West 160.0 feet to a point; thence North 25 degrees 16' 10" East 85. 0 feet to a point; thence South 59 degrees 01' 00" East 160, 0 feet to the point of beginning. TOGETHER with the right to the use of a right of way in common with others over a 50 foot private road, described as follows: The Northwesterly line of said 50 foot private road is described as follows : BEGINNING at a point on the Southwesterly line of Bayview Road, said point being South 59 degrees 01' 00" East 579.50 feet from a monument set at the intersection of said course which runs South 59 degrees 01' 00" East with that course of said Southwesterly line which runs South 51 degrees 00' East, from said point of beginning; running thence 2 courses as follows: 1. South 25 degrees 16' 10" West 517.0 feet to stake; 7.. South 46 degrees 38' 50" West 160.24 feet to land of Palmer. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE. AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the. Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
