of Southold, Suffolk County, New York, made by Otto W. Van Tuyl &
Son, Licensed Land Surveyors , Greenport, New York, and filed in the
Office of the Clerk of the County of Suffolk on June 8, 1965 as Map
No, 4362,
"As corrected by Certificate of Correction, Filed in Suffolk County
Map Department 10/4/65 by Van Tuyl Professional Engineer and Land
Surveyor of the State of New York under License No, 1582 and recorded
in Liber 5833 cp 52 on 10/4/1965 ."
Distance along southerly line of lot 39 shown as 185.10, should be
184.89. Bearing along westerly line of lot 39 , shown as North
25 degrees 58 minutes 30 seconds East, should be North 25 degrees
50 minutes 30 seconds East. Distance along southerly line of
lot 39 and others easterly to Brigantine Drive , shown as 1091,17,
should be 1090.96.
TOGETHER with an easement over the streets as shown on the filed map
herein to the nearest public highway,
TOGETHER with the use, in common with others, of the beach area and
parking area adjacent thereto; said beach area having a deppth of
ap roximately 5d feet from the average high water mark on Peconic Bay,
andp having a len th of 900 feet more or less measured along the
ordinar Fii�h wa er mark, and said parking area having a frontage on
the nor her y si a of Harbor Lights Drive of approximately 150 feet,
runningwesterly along said street from Lot #7, and having a depth of
not less than 150 feet northerly of Harbor Lights Drive, The parking
area shall be immediately adjacent and contiguous to the beach area
herein referred to.

and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
