BETWEEN Barton C. Foster, and Margaret G: Foster, his wife, both residing at
10 Monroe Way, Merrit Island, Florida, formerly residing in Suffolk County,
New York,

NSETH,that the party of the first part consideration of Tea Dollars and other valuable consideration

y grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beino tshex at Southold, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at an iron pipe set on the easterly line of Oaklawn Avenue, 395. 57
feet southerly along said easterly line from Pine Neck Road, being the intersec-
tion of said easterly line with the southerly line of a proposed highway over land
d a now or formerly of Gagen; running thence along slid southerly line of said proposed
cc highway, north 82°37110" east, 90 feet to an iron pipe; thence along other land now
or formerly of Gagen, 2 courses, as follows: 1) south 1°28110" west, 155.99 feet
to an iron pipe; thence (2) north 83°48100" west, 100. 35 feet to an iron pipe on said
easterly line of Oaklawn Avenue; thence along said easterly line of Oaklawn Avenue,
north 6°12100" east, 134. 32 feet to the point or place of beginning.
BEING and intended to be the same premises conveyed to the party of the first part
by Sarah E. Gagen by deed recorded in the Suffolk County Clerk's office May 13,
1955, liber 3886 of conveyances, at page 101.
SUBJECT to: (1) any state of facts an accurate survey :night show; (2) covenants,
restrictions, easements, agreements, reservations, and zoning regulations of
record, if any; (3) rights of present tenant under a lease agreement dated October 1,
1969, for a term of one year commencing October 1, 1969, and ending October 1,
1970; and (4) an existing mortgage of record held by the Northport Federal Savings
and Loat Association upon which there is now due and owing the principal balance
of $12, 644. 66, which the purchaser hereby agrees to assume and pay, and to that
end has executed and acknowledged this deed.

TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any stree4 mW

HOLD the premises herein granted unto the party of the second part, the heirs or sueces on and assigns of

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Ucl Law, covenants that the party of
the first part will receive the consideration for this conveyanze and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same tor
any other purpose.
The word "party" shall be construed as if it rad "parties" whenever the sense of this indenture so requires.
