and State of New York, known and designated as Lot numbered 5 on a
�i certain map entitled "Map of South Harbor Homes" and filed in the
Office of the Clerk of the County of Suffolk on July 14, 1964 as Map
No.4096.
SUBJECT to a mortgage in the sum of $3,000.00 given by the parties
of the second part to the party of thefirst part to secure the payment
of a part of the purchase price of said premises bearing even date
and intended to be recorded simultaneously herewith.
SUBJECT to the following reservation: The party of the first part
reserves all rights in the streets, roads and avenues shown on said
filed map for the purposes of erecting poles for electric and telephone
service and for the laying of gas and water mains and for the granting
to public utility Corporations of easements therein for such purposes.
SUBJECT to the following covenants and restrictions which shall run
with the land :
1. The premises shall be used solely for residential purposes and no
business shall be conducted thereon.
2. No structure shall be placed upon said premises until the plans
and specifications Of such structure and the location thereof shall be
approved by the party of the first part, such approval shall not,
however, be unreasonably withheld.
3. No tractor or trailer shall be parked in the street, driveway or
side yards of said premises.
4. No boats shall be stored on the premises except in the rear thereof
neatly covered or in the garage upon said premises.
5. No fence shall be erected or permitted upon said premises exceeding
four (4) feet in heighth nor may any fence be erected across the front
property line .
6. Parties of the second part covenant that they will not conduct or
permit any acts on the premises which would constitute a puisance.
7. No house trailers shall be allowed upon said premises.
8. The building set-back shall be forty (40) feet from all roads,
instead of the 35 feet set-back as shown on the aforesaid mentioned map,
