HART and ANNA MARIE HART, his wife, both 1 X residing at 1445 Richland Blvd. , Ray Shore, N.Y. , 44v _ party of the second part, a WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, PARCEL i ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and designated as and by the Plots Nos. 1, 29 39 4, 5 and 6 on a certain map entitled, "Map of Goose Bay Estates", in the Town of Southold, Suffolk County, N.Y. , said map being made by Lewis N. Waters, L.W. of Oyster Bay, L. I. , N.Y. , dated Sept. 12, 1934, and filed in the Office of the Clerk of the County of Suffolk on the 13th day of November 19349 as and by the Map No. 1176, (Abstract No. 1197) . PARCEL 2 ALL that certain plot, piece or parcel of land, situate, lying and being at Bayview, near Southold, in the Town of Southold, County of Suffolk and State of New York, particularly described as follows: BEGINNING at a concrete monument set at the southeasterly corner of Lot No. 2 as shown on a map entitled "Map of Goose Bay Estates at Southold; L.I." and filed in the Suffolk County Clerk's Office Nov. 13, 1934 as Map No. 1176; running thence along the easterly end of Lot Nos. 29 39 4* 5 and 6, as shown on said Map, North 19 deg. 30 sec. east 100 feet to the northeasterly corner of said Lot No. 6; thence along land now or formerly of Alexander Cameron South 72 deg. 25 min. 30 sec. east 157.64 feet; thence at right angles to the last described line south 17 deg. 34 min. 30 sec. west 98.29 feet to land now or formerly of Charles E. Terry; thence along the last described land North 73 deg. 01 min. 10 sec. west 160.71 feet to the point of beginning. BEING the same premises as conveyed by deed dated 12/17/68 from Constance Martens as grantor to Viola Manarel grantee, said deed being recorded 12/27/68 in the Office of the Clerk of Suffolk County in liber 6479 cp 566. Premises also known as 70 Pine Ave. , Southold, N.Y. SUBJECT to any state of facts an accurate survey may show. SUBJECT to covenants, restrictions, agreements and public utility easements of record. TOGETHER with all right, title and interest, if any, of the party, of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
