THIS INDENT1URE, made the 21st. day of Septembel; nineteen hundred and seventy.
BETWEEN DONALD E. TUTHILL and LORNA E. TUTHILL, his wife, both re-
siding at Boisseau Avenue, Southold, Town of Southold, Suffolk County,
New York,

party of the first part, and JOSHUA FIERER and BARBARA FIERER, his wife, re-
siding at Clark Road, Southold, Town of Southold, Suffolk County, New
York, as tenants by the entirety,
party of the second part,
\ WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration

ALL that certain plot, piece or parcel of land,
lying and being bLdw at Southold, Town of Southold , County of Suffolk and
State of New York, shown and designated as Lot No. 21, ,pn a certain
map entitled "Map of Yennecott Park situate at Southold, Town of
Southold, Suffolk County , New York", surveyed by Van Tuyl & Son, Green-
port, New York, May 1, 1968, and filed in the office of the Clerk of the
County of Suffolk on the 9th day of October, 19689 as Map No. 5187.
SUBJECT to fill easement over that portion of said Lot 21 bounded and
described as follows:
BEGINNING at a point on the southerly line of Long Creek Drive, 543.08
feet easterly along said southerly line from Tuthill Road, said point
of beginning being the northeasterly corner of Lot 22 and the north-
westerly corner of Lot 21, as shown on "Map of Yennecott Park", filed
in the Suffolk County Clerk's Office as Mao #5187; from said point of
beginning running along said southerly line of Longa Creek Drive, S. 72°
381 E. 70.0 feet; thence through said Lot 21, No 88 08 W. 72.64 feet
to said Lot 22; thence along said Lot 22, N. 17 221 E. 19.41 feet to
the point of beginning
SUBJECT to covenants and restrictions recorded in the Suffolk County
Clerk' s Office on the 10th day of October, 19680 in Liber 6435 at page
221.
TOGETHER with an easement of right of way for all legal purposes over
the adjoining streets to the nearest public highway, but the title to
said streets is not hereby conveyed, the party of the first part re-
serving the fee to said streets for the purpose of dedication of the
same to the proper municipality.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to slid premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
