WITNESSETH, that the party of the first part, in consideration of ten and 00/100 ($10. 00}------

by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the parte of the second part forever,
ALL that certain plot, piece or parcel of land, xitkt tlY§c§z" situate,
lying and being RKrA SX at Southold, in the Town of Southold, County of Suffolk, State
of New York, known as part of Lot #16 on Map of South Harbor Homes, said Map
being filed in the Office of the Clerk of the County of Suffolk on the 14th day of
July, 1964 as Map #4096, more particularly bounded and described as follows:
BEGINNING at a monument set at the northwest corner of Lot #17 as shown on a
certain realty subdivision map entitled "South Harbor Homes", at Southold, Town
of Southold, Suffolk County, New York, filed in the office of the Clerk of the County
of Suffolk as Map #4096 on July 14, 1964, which said monument is South 85 degrees
09 minutes 50 seconds West 434. 10 feet from a monument set at the westerly ter-
minus of an arc of a curve connecting the southerly line of Grange Road with the
westerly line of Bayview Road, and RUNNING THENCE from said point of beg-
inning South 4 degrees 50 minutes 10 seconds east along said lot #17, 179. 21 feet
to the land now of Rene Gendron; THENCE Westerly along the land of Rene Gendron
South 85 degrees 03 minutes 50 seconds west 100 feet to the easterly line of Lot #15
as shown on aforesaid map; THENCE North 4 degrees 50 minutes 10 seconds west
along said Lot #15, 179. 39 feet to a monument set on the southerly line of Grange
Road; THENCE North 85 degrees 09 minutes 50 seconds east along the southerly
line of Grange Road 100. 00 feet to the point or place of BEGINNING.
RENE GENDRON, the grantor herein, is the same person as RENE GENDRON,
grantee, in the deed from ANTONE KRUPSKI and HENRY KRUPSKI, dated
September 27, 1961, recorded October 10, 1961, in Liber 5062cp91.
The party of the first part reserves all rights in the streets, roads and avenues
shown on said map for the purposes of erecting poles for electric and telephone
service and for the laying of gas and water mains and for the granting to public
utility corporation of easements therein for such purpose. This deed is made
subject to the following covenants and restrictions running with the land:
1. The premises herein conveyed shall be used solely for residential pur-
poses, and no business shall be carried on upon the premises hereby conveyed.
2. No structure shall be placed upon said premises until the plans and
specifications of such structure and the location thereof upon the property above

described shall be approved by the party of the first part, but such approval shal
not be unseasonably withheld by the party of the first part,

3. No tractor or trailer shall be parked in the street; driveway or side yards
of the premises hereby conveyed.
4. No boats shall be stored on the premises hereby conveyed except in the rear
of the lots, neatly covered or in the garage upon premises hereby conveyed.
5. No fence shall be erected or permitted upon said premises exceeding four (4)
feet in height, hor may any fence be erected across the front property line of the
premises hereby conveyed.
6. The parties of the second part covenant that they shall not conduct or permit
any acts which would constitute a nuisance on the premises hereby conveyed.
7. No house-trailers shall be allowed upon the premises hereby conveyed.
S. The building setback shall be 40 feet from all roads, instead of the 35 feet
setback as shown on the aforementioned map.
The parties of the second part have simultaneously herewith executed and delivered
a purchase money mortgage to the party of the first part in the amount of $3, 250. 00,
intended to be recorded simultaneously herewith which covers the herein before
described property and another parcel of property.
