hereby grant and release unto the puny of the second pan, the heirs, successors or assigns of thc
puny of the second part forever,
ALL that certain lot, piece or parcel of land together with the buildings and improvements
Iocawd and to be erected thereon, situate, lying and being in East Marion, Town of Southold.
County of Suffolk and State of New York. known and described as lot #68 on a certain map
cntillcd, "Map of Section 3. Cie. aves Point, filed in the office of the Clerk of the County of
Suffolk as Map no. 4650 on June 14, 1966.
BEING the same premises conveyed by Bernard Kaplan and Theodore Kaplan, dFo/a Dawn
Estates, Grantors, to Tordis Wallin, Grantee, by IX'cd dated May 4. 1974 and recorded in the
Suffolk County Clerk's Office on July 5, 1974 in Libor 7668 of Deeds at page 599.
THE PARTY OF THE FIRST PART named herein is the sole beneficiary of the Party of the
Second Pan. The Anders Gustav Wallin Living Trust, dated 1/26/06, and The Tordis Wallin
Living Trust, dated 1/26/06, during the lifetimeis) of the Puny of the First Pan and is entitled
to velerans and senior exemptions as provided under RPTL subsections 458(7). 458-a(5) and
46719), and the school tax relief(STAR) exemption as provided under RPTL section 425.
SUBJECT to covenanls, conditions, restrictions and rights ofway of record, if any.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the cemer lines thereof,
TOGETHER with the appurtenances and all the cstate and rights of the party of the first part in'
and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party oftbe first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration tbr this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
