WITNESSETH, that the party of the first part, in consideration of Three Hundred Two Thousand Five Hundred

release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, in the Town of Southold. County of Suffolk and State of New York, being more
particularly bounded and described as set forih on Schedule A herato.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed, dated
March 22.2002 and recorded in the Office of the Suffolk County Clerk on April 1 O, 2002 in Llber 12179 page 494.
TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, tile heirs or successors and assigns of the party of the second
part forever.
AND the p. arty of the first part covenants that the party of the first part has not done or suffered anything whereby
the saldl.premi.'ses have bee~ encumbered in any way whatever, except as aforesaid.
AND th.e party of the first part, in compliance with Section 13 of the Uen Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as If it read 'parties' whenever the sense of this indenture so
requires.

Town of Soulhold, Suffolk County, State of New York, being a part of that portion of
Fishers Island lying to the east of Peninsula Road, said lot or parcel of land being bounded
and described as follows:
BEGINNING at an iron pipe on the northwesterly side of a road 45 feet wide, said iron pipe
being located 1582.48 feet South of a point which is 1456.83 feet West of a monument
marking the U.S. Coast and Geodetic Survey Triangulation Station "NIN", said point of
beginning also marking a point of curve to the right whose radius is 235.47 feet and the
direction of whose radius at that point is South 33 degrees 58 minutes 04 seconds East:
RUNNING THENCE northwestwardly along said road line following the arc of said curve
88.92 feet to a point of a curve to the left whose radius is 10.00 feet and the direction of
whose radius at that point is North 12 degrees 19 minutes 48 seconds West;
THENCE northeaslwardly along the northwesterly line of another road following the arc
of said curve, 16.70 feet;
THENCE along the southwesterly line of said other road North 18 degrees 00 minutes 30
seconds West, 82.50 feet to a point of curve to the right whose radius is 669.82 feet and
the direction of whose radius at that point is North 71 degrees 59 minutes 30 seconds
East:
THENCE northwestwardly along said road line following the arc of said curve, 208.14 feet
to an iron pipe;
THENCE South 89 degrees 47 minutes 45 seconds West, 270.00 feet to an iron pipe;
THENCE South 37 degrees 20 minutes 41 seconds West, 203.05 feet to an iron pipe;
THENCE South 65 degrees 06 minutes 20 seconds East, 400.00 feet to the point or place
