THIS INDENTURE, made the Z 2 KA day of October ,nineteen hundred and Seventy-One
BETWEEN JAMES H. MCCARTHY and DOLORES A. Mc. ARTHY, his wife, both

WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable con-
sideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk, State of
New York, known and designated as Lot 9 on a certain map entitled,
"Map of Willow Point" and filed in the Suffolk County Clerk' s Office
- . ..ccs on June 16, 1966, as Map Number 4652.

\,'7 CD TOGETHER with the right in common with others owning lots in this
subdivision, to the use of a marina and beach area shown on said
subdivision map.
BEING AND INTENDED TO BE the same premises which were conveyecl to
the parties of the first part by deed dated October 26, 1970, and
recorded in the Office of the Clerk of the County of Suffolk in
Liber 6833, at page 234, on November 4, 1970,
SUBJECT to such regulations and annual assessments as may be prescribed
12 by an association of property owners.
SUBJECT to Declaration of Covenants and Restrictions recorded in the
Suffolk County Clerk' s Office on July 13, 1966 in Liber 5991 cp. 460.
SUBJECT to Declaration of Covenants and Restrictions recorded in the
Suffolk County Clerk' s Office on April 16, 1970 in Liber 6730, cp. 308.

party part covenants that the party of the first part has not done or suffered any-
whereby the said premises have been encumbered m any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same fust to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
