VAN NOSTRAND, residing on Pine Neck Road, Southold, New York 11971 party of the first part, and LANN, G.PRILEY, residing at 40 Longview Road, Port Washington, New York 11450 party of the second part, nl WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the'party of the second part, does hereby grant and release unto the party of the second part, the heirs t7 or successors and assigns of the party of the second part forever, t AL1. that certain plot, piece or parcel of land, with-the buildings and improvements thereon erected, situate, lying and being bLlkx at Pine Neck, in the Village and Town of Southold, Co tasty of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the southerly line of Pine Neck Road, 191. 57 feet easterly along said line from its intersection with the easterly line of Park Way as marked by a concrete monument, and which point is the northwesterly corner of the premises herein described; and running from said point of beginning along j the southerly line of said Pine Neck Road, two courses, as follows: (1) North 85 degrees 55 minutes 20 seconds East, a distance of 30. 0 feet to a a stone monument; thence (2) North 81 degrees 40 minutes 00 seconds East a distance g of 13a 0 feet; thence along land now or formerly of Ellsworth C. Grathwohl and Winifred F. Grathwohl, his wife, three courses, as follows: (1) South 5 degrees 20 minutes 30 seconds East a distance of 150. 35 feet; thence (2) South 85 degrees 55 minutes 20 seconds West a distance of 173. 0 feet; thence (3) North 3 degrees 38 minutes 50 seconds West a distance of 140. 0 feet to the point of beginning. TOGETHER with a twenty (20) foot right of way over certain premises formerly of Ellsworth C. Grathwohl and his wife lying on the north side of Pine Neck Road to Jockey Creek, the westerly line of which right of way commences on the northerly side of Pine Neck Road at a point which is North 63 degrees 37 minutes 30 seconds East a distance of 159. 82 feet from the northwesterly corner of the premises hereinabove described as shown by survey made by Otto W. Van Tuyl & Son dated July 20, 1961, which survey was attached to the deed dated August 1, 1961 between Roland H. Timm and Elsie M. Timm, his wife, and Agnes B. Van Nostrand which was recorded in Liber 5028 of Deeds Page 239 in the Office of the Clerk of Suffolk County on August 4, 1961. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first pant covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
