Kuerner, his wife; both resid- ing at 63-44 - 61st Street, Ridgewood, New York; party of the second part, a WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grand%nd release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being kvtbc at Arshamomaclue, . Town of Southold, County of Suffolk and State of New York, bounded and described as follows: coo it Beginning at a point on the southwesterly line of a 20 foot right of way known as Carole Road (running from the North Road to Arshamomaque Pond) marking the northwesterly corner of land now or formerly of Gragiano, and running thence f� along said line, north 31°40150" west, 50 feet to a point; thence north 61059110" east, 110 feet, more or less, to a point on the ordinary high water line of Old I Cove, an indenture of Arshamomaque Pond; thence on a southeasterly direction along the ordinary high water mark of Old Cove, a distance of about 50 feet to a point marking the northeasterly corner of said land of Gragiano; thence south a61°59'10" west, about 110 feet, more or less, to the point or place of beginning. TOGETHER with the right to pass and repass for purposes of ingress and egress y over Carole Road from the premises to the North Road. TOGETHER with all the right, title, and interest, if any, of the party of the first part of, in, andtD the lands under the waters of Old Cove adjacent to said premises. TOGETHER with an easement, in common with others, to set- points, lay, operate, repair and maintain pipes to extract water for ordinary household purposes from the premises described as follows: beginning at the southwesterly corner of the land described and running thence along the southwesterly line of Carol Road north 31°40150" west, 50 feet to a point; thence south 61°59'10" west, about 37 feet to a point and land now or formerly of Wenzel; thence south 46°19' 50" east, about 55 feet to a point; thence north 61°59'10" east, about 30 feet to the point or place of beginning. SUBJECT to any state of facts an accurate survey might show, and covenants, restrictions, easements, agreements, reservations and zoning regulations of record, if any. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
