TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the p
g party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever, each having an undivided
fifty percent interest, as tenants in common.
This conveyance is subject to a mortgage held by Frederick C.
Koke in the sum of $12,000.00 now reduced to $9,705.67 (Liber 4729 mp
09) with interest from August 14, 1971, the payment of which mortgage- -
(and the accompanying bond) is hereby assumed by the parties of the
second part herein. The parties of the second part herein agree to

the unpaid balance of principal and interest on said bond and
mortgage and do further covenant and agree that they will hold the
said Clement Biddle and Katherine N. Biddle, his wife, free and
harmless from any claim for unpaid interest or principal of said
bond and mortgage, or any part thereof. The parties of the second
part do further covenant and agree that they will indemnify the said
Clement Biddle and Katherine N. Biddle, his wife, against any claim -
for such interest or principal and for any attorney's fees and ex-
penses lawfully incurred by them in connection therewith. The parties
of the second part do further covenant and agree that no sale or
transfer of said premises will be made by them (other than a sale or
transfer to each other) until said bond and mortgage have been fully
satisfied or until the said Clement Biddle and Katherine N. Biddle, '
his wife, have been fully released from any and all liability on said
bond and mortgage. The parties of the second part have executed and
acknowledged this instrument for the purpose of evidencing their
assumption of and agreement to pay said mortgage and the agreement in
full as set 6orth herein.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
