THIS INDENTURE, made the 7th day of April nineteen hundred and seventy-one BETWEEN THELMA M. TIERNEY, residing at 38-18 204th Street, Bayside, New York, COD CV, 0 party of the first part, and V = SALVADOR F. DESPOSITO and ARMIDA C. DESPOSITO, his wife, both residing at 39 Driscoll Avenue, Rockville Centre, New York, et t party of the second part, 3 WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, mkbrAdxbmWkijM situate, lying and beingimdha at Southold, in the Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: BEGINNING at a point on the South Westerly side of Kenny (Kenny's) Road at the extreme South Easterly end of the arc of a curve connecting the SouthWesterly side of Kenny Road with the South-Easterly side of Lake Drive; running thence South 40 degrees 53 minutes 00 seconds East along the SouthWesterly side of Kenny Road 249. 00 feet to the NouthWesterly line of land now or formerly of D'Antonio;. thence South '49 degrees 07 minutes 00 seconds West along last mentioned line, 5. 00 feet to a point; thence Westerly and thru the waters of Great Pond on a Tie-Line course and distance of South 85 degrees 05 minutes 08 seconds West 148. 1 feet to the north Easterly line of land now or formerly of Agnes D. Nelson; thence North 44 degrees 24 minutes 30 seconds West along last mentioned land and passing thru 2 stakes, 218. 70 feet to a stake on the SouthEasterly side of Lake Drive; thence NorthEasterly along the said SouthEasterly side of Lake Drive the following 2 courses and distances: (1) Along the arc of a curve bearing to the right having a radius of 102, 66 feet a distance of 18. 34 feet to a concrete monument (2) North 60 degrees 08 minutes 30 seconds East 93. 15 feet to a concrete monument an4the extreme SouthWesterly end of the curve first at= above mentioned, thence North Easterly and South Easterly along the arc of said curve bearing to the right having a radius of 35. 95 feet a distance of 49, 55 feet to the South Westerly side of Kenny Road at the point or place of BEGINNING. THELMA M. TIERNEY is the same person as the grantee in the deed from WILLIAM B. SMITH to THELMA M. TIERNEY, dated May 18, 1962 and recorded in the County Clerk's Office of Suffolk County, New York, on May 25, 1962 in Liber 5170, Page 517. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
