THIS INDENTURE, made the 7 day of September , I iuetcen hundred and seventy—one
BETWEEN WILLARD E. MORSE, residing at 55 Birch Court, Riverhead,
New York 11901, and ANDREW L. MORSE, residing at (no number) Peconic
Lane, Peconic, New York 11958, the said Willard E. Morse being the
same person as Willard Ernest Morse, and the said Andrew L. Morse,
being the same person as Andrew Lewis Morse,
party of the first part, and ROBERT D. BOYD and LUELLA G. BOYD, his wife, as
tenants by the entirety, both residing at (no number) Midwood Road,
ICutchogue, New York 11935 ,

successors and assigns of tate party of the second part forever,
ALL that certain plot, piece or parcel of land, N6th the buildings and improvements thereon erected, situate,
lying and being 4N4kK near Southold, in the Town of Southold, County of
Suffolk and State of New York, known and designated as and by Lot
numbered 34 on a certain map entitled, "Map of Goose Neck, situate
at Bay View, Town of Southold, Suffolk County, N. Y. , " said map
being made by Otto W. Van Tuyl, licensed surveyor, Greenport, N. Y. ,
dated February 27 , 1948 and filed in the Suffolk County Clerk' s
Office on November 22, 1948 as and by Map No. 1663.
BEGINNING at the southwesterly corner thereof and at the point of
intersection formed by the easterly side of a public highway known as
( Williams Road and the northeasterly side of a public highway known as
Smith Drive North; running thence in a general northerly direction
I along the easterly side of said Williams Road North 4 degrees 30 minutes
East, a distance of 186.31 feet, more or less, to the average high
water line of West Creek; running in a general easterly direction along
the average high water line of said West Creek, a distance of 89.22
feet, more or less, to a point; running thence in a general southerly
or southwesterly direction, a distance of 195.25 feet, more or less,
to the northeasterly side of said Smith Drive North; running thence in
a general northwesterly or westerly direction along the northeasterly
side of said Smith Drive North as the same curves a distance of 30
feet, to the point or place of beginning.
The land described herein is registered in the Suffolk County
Registrar' s office under Uwners Duplicate Certificate of Title
#85, 124, which is dated September 21, 1971.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
TOGETHER with all the right, title and interest 4f the parties
of the first part of, in and to the public highways known as Smith Dr.
North and Williams Road in front of and adjacent to said premises and
to the center line thereof, and in and to West Creek, the waters
thereof and the lands under the waters thereof in front of and
abutting said premises on the northerly side thereof.
TOGETHER with the right to use, for all reasonable purposes for
bathing, boating, fishing, sporting and recreation, in common with
other plot owners on said Map, or owners who may hereafter acquire
other plots as laid down on said Map, subject to such reasonable
rules and regulations with respect to the use thereof as the parties
of the first part may from time to time put in effect, the following
described premises :
BEGINNING at a point on the curved northeasterly line of Smith
Drive North 150 feet southeasterly along said line from a monument
set at its intersection with the easterly line of Williams Road; and
running thence along other land of the parties of the first part N.
490 13 ' E. 250 feet, more or less, to the ordinary high water mark
of Goose Creek; thence southeasterly along said ordinary high water
of Goose Creek 110 feet, more or less, to other land of the parties
of the first part; thence along said other land of the parties of
the first part S. 690 00 ' w 250 feet, more or less, to the easterly
line of said Smith Drive North; thence northerly along the curved
easterly line of said Smith Drive North 23 .09 feet to the point of
beginning.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incuniered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvzment and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be <x,nstrued as if it read "parties" whenever the sense of this indenture so requires.
IN VVITNESS WHEREOF, the party of the first part has drily executed this deed the day and year first above
written.
