THIS INDENTURE,made the 10th day of October , nineteen hundred and severity-two
BETWEEN GEORGE HERON and MAUD HERON, his wife, both residing at
902 Palermo Road, S1= . Augustine Shores , Florida 32084
party of the first part, and RUTH F. WELLS , residing at Gin Lane, Bay Haven,
Southold, New York 11971 ,
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
1D ALL that certain plot, piece or parcel of land, situate,
.� lying and beingjip*ir at Bayview, near Southold, in the Town of Southold,
Countv of Suffolk and State of New York, known and designated as
Lot number twenty-six (26) on a certain map entitled "Bay Haven at
e Southold, Town of Southold, Suffolk County, New York," surveyed
December 10, 1.958, by Otto W. Van Tuyl & Son, Licensed Surveyors ,
Greenport , New York , and filed in the Office of the Clerk of Suffolk
County on the 22nd day of January, 1959 , as Map No. 2910.
TOGETHER with a right of way over "Bay Haven Lane,"
'Watersedge Way," "Gin Lane" and "Mid Way" as shown on said map, and
the right, in conunon with other owners of lots shown on said map to
the use of the "Community Beach" as designated on said map.
SUBJECT to the provisions of the declaration recorded by
william Wells on hebruary 10, 1959 , in the Suffolk County Clerk' s
Office in Liber 4585 at page 346 .
The party of the second part agrees for herself, her heirs ,
executors , administrators and assigns , that she will join the Southold
Bay Haven Property Owners Association , Inc . , and will abide by the
rules and regulations of said association as set forth in the by-

roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
4=1 and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO

AND the party of the first part, in compliance with Section 13 Of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
to cration as a trust fiord to be applied frst for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
ro any other purpose.
The word "party" shall he construed as if it read "parties" whenever the sense of this indenture so requires.
