SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 29,558 sq. ft. parcel has frontage along Calves Neck
Road and is improved with a single-family residence and accessory garage building, as shown on survey
prepared by John T. Metzger, Surveyor dated 2/27/06.
BASIS OF APPLICATION: Request for a Variance under Section 280-122, based on the Building Inspector's
October 26, 2006 Notice of Disapproval concerning alterations and/or reconstruction of an existing sunroom,
which will increase the degree of nonconformance when located less than 15 feet on a single side yard (ZBA
Interpretation No. 5039 in the Walz application).
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred, as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, to the Suffolk County Department of Pianning,
and a repiy was submitted on January 9, 2007 stating that the application is considered a matter for local
determination as there appears to be no significant county-wide or inter-community impact.
TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is determined exempt under
Town Code Chapter 268-3, also confirmed in a November 29, 2006 LWRP Report submitted to the ZBA by
Mark Terry, LWRP Coordinator.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 25, 2007, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant is requesting reconstruction of the covered porch
with a roof line modification, for an 8.1 x 17.9 x 12.8 sunroom, shown on the surveyor's site map dated
January 2, 2007 prepared by John T. Metzger, L.S. The setback is proposed at 13.9 feet from the easterly
side yard lot line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The renovation will not have any visual impact on the neighborhood other than
that contributed by design.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The porch roof that exists is in need of repairs.
3. The variance granted herein is not substantial. The change of roofline wili amount to an increase from
9'11" to 11'3" high. The increase in lot coverage is 107 square feet due to an extension of the overhang.
There will be no noticeable change in the building footprint, and no change in habitable space.
4. The difficulty has been self-created. It is the result of redesigning the porch into a heated sunroom with a
new roof line.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions In the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of a reconstruction of an existing porch, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly
carried, to
GRANT the variance as applied for, as shown on the survey prepared by John T. Metzger, Surveyor
dated 1/2/2007 and construction diagrams prepared Nancy Dwyer, Design Consulting dated 9/8/2006.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams
or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

The reconstruction to a non-conforming dwelling, on this nonconforming lot. is not permitted pursuant
to Article XXIII Section 280-122 which states:
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided that such
action does not create anv new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
The survev indicates a proposed sunroom alteration with a side vard setback of 13.9'. Pursuant to the
ZBA's interpretation in Walz (#5309), such additions and alterations will thus constitute an increase in
the degree of nonconformance. Pursuant to the Section 280-124, such buildings on lots between 20,000
and 39,999 Sq. ft. shall have a minimum side vard setback 15'.

Part A: AREA VARIANCE REASONS (attach extra sheet as needed):
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because:
Existing House is being renovated. The existing sun porch will have the roof change from a
shed roof to a flat roof. The roof change enables the owner to install nicer windows. The design
change will enhance the architectural style of the classic enclosed sun room. The roof is now
leaking and the renovation will address this problem. A decorative rail is also proposed.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because:
The sun room is existing, the shed roof would result in smaller windows and eliminate the
decorative deck rails (which is a design element to match the deck rails on the opposite side of
the house). The Balcony is not accessible from the second floor (design element).
(3) The amount ofrelief requested is not substantial because:
the roof change is minor the existing roof is 9' 11" and the proposed is 11 '3". The change is a
design element not a change to the habitable space.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because: The sun porch is existing and 13.9 feet from
the property line. The proposed remains the same.
(5) Has the variance been self-created? (X )Yes, or ( )No. Ifnot, is the construction
existing, as built? ( )Yes, or (X )No. The house is being renovated, the sun porch is not
being changed until the variance is decided.
(6) Additional information about the surrounding topography and building areas that relate to
the difficulty in meeting the code requirements: (attach extra sheet as needed) There is no change
to the setbacks. The one foot alteration to the roof design does not impact the habitable space.
The Board's interpretation should be refined to prevent the need for variances for alterations to a
nonconforming structure which do not increase the habitable space. Examples of this might be a
slab to crawl space (no increase to habitable space) or roof design change where there is no
increase to the habitable space. These variances result in owner and Town expense and ZBA
manpower.
This is the MINIMUM that is necessary and adequate, and at the same time preserves and
protects the character of the neighborhood and the health, safety, and welfare of the
community. The sun porch is not changing, other than the architectural style of the windows,
which changes the roof pitch.

b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, anew permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The
applicant agrees to comply with all applicable laws, ordinances, building code, housing code, and regulations, and to admit

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based
upon the information provided on the L WRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is exempt from
review pursuant to Chapter 268-3, Exempt Minor Actions, item B which states.
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site,
including upgrading buildings to meet building or fire codes, except for structures in areas designated by
the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or
reconstructed without a permit"
