Donlin Property Location: 910 New Suffolk Avenue, Mattituck CTM 114-12-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 20,597 sq. ft. parcel with 60 feet along New Suffolk Avenue and lot depth of 330 feet along the westerly lot line. The property is improved with a single-family dwelling as shown on survey prepared by John T. Metzger, Land Surveyor dated 1/29/02 updated 2/2/06. BASIS OF APPLICATION: Request for a Variance under Section 280-124, based on the Building Inspector's December 4, 2006 Notice of Disapproval concerning a proposed addition and alterations to the existing dwelling at less than 15 feet from the side yard line. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning Reply dated February 22, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is determined exempt under Town Code Chapter 268-3(F) because the granting of setbacks are not related to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 22, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The owner-applicant proposes constructing a second-story addition over an existing one-story section on the rear (southern) side of their house, maintaining existing side yard setbacks on the ground level, with one-foot overhang on the second story addition that will be 12.4 feet from the easterly side lot line, as shown on the 11//17/2006 plot diagram prepared by Donald G. Feiler, R.A. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—March 8,2007 S ZB File No. 6003-Carole G. Donli CTM Parcel#114-12-8 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The rear yard addition will be invisible from the street and mature vegetative buffers along the easterly and westerly property boundaries ensure minimal visual impact for neighbors. The proposed addition is architecturally appropriate to the existing house and neighborhood and will enhance the appearance and utility of the house. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because the current side yard setbacks are already non-conforming, varying from 14'5" to 12' on the easterly property boundary, with a 3' side yard setback to the west, created when alternative relief was granted to the owner/applicant by the Board of Appeals in 1999 for the attached carport (Application #4730). The proposed addition will add a new bedroom, bathroom and closet in the new second floor section, and will also bring an existing second floor bathroom located toward the front of the house into compliance with all codes. 3. The variance granted herein is not substantial. The ground level side yard setbacks will be maintained; there will be no increase to the existing footprint; and the requested one foot additional variance of 12.4 feet from the easterly property boundary is because the proposed second-story addition will overhang the first floor wall by one foot, causing virtually no impact on side yard access. 4. The alleged difficulty has not been self-created. The existing house, when built in 1910, was sited at an angle on a very narrow and deep lot measuring 60' wide along the street, 330' along the western property boundary and 358' along the eastern property boundary, and with non-conforming side yards (survey by John T. Metzger dated Jan 2, 2006). Given these restrictions and the interior room arrangement of the existing house, there is no alternative location for an addition. 5. No evidence has been submitted to suggest that the proposed addition will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-story addition to the dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 11/17/2006 plot plan/elevation diagram prepared by Donald G. Feiler, R.A. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. ' Donlin Appeal Application -Page 111, • BACKGROUND The original structure was built in 1910 on a narrow parcel on New Suffolk Avenue. The two-story house was 24' by 24' with an 8' front porch. The house was not placed squarely on the north end of the parcel. Rather, it was angled slightly from the northwest corner to the southeast. The eastern setback was 14.0' at the north end and 12.0' at the south end of the original house. A copy of Certificate of Occupancy - Nonconforming Premises #Z14311 dated April 11, 1986 is annexed. In 1986, a deck was added to the back of the house which decreased the eastern setback to approximately 11 feet. A copy of C/O # Z14769 dated August 6, 1986 is annexed. C/O #Z-19949 dated June 5, 1991 was issued for an as built accessory shed. Copy annexed. CIO Z-29236 covers a one-story addition with new decks and alterations to the original dwelling. That C/O references a NYS variance allowing a bathroom in the second story roof area with a horizontal ceiling height of 7'2" sloping down to 5'61/2" on the opposite wall. The addition included a renovated kitchen and a new dining room on the first floor at the rear of the house. A copy of the C/O with NYS variance is annexed. Pursuant to a variance of this Board, a carport was added to the northwest side of the structure. Analogizing to the setback applicable to a detached accessory structure, the Board granted a variance of 3' setback from the westerly side yard. A copy of C/O #Z-29273 dated February 19, 2003 with Board determination is annexed. Applicant seeks to construct a second-story addition over the kitchen/dining area. A new master bedroom, bath, walk-in closet, and small balcony are proposed. The second floor would overhang the eastern wall of the existing house by 1 foot. The nonconforming second- floor bathroom would be brought up to Code in connection with the renovation. Accordingly, applicant seeks a variance of 2'8" which will permit the construction of an addition no closer than 12'4" from the eastern boundary. ANALYSIS 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) The large majority of the parcels in the neighborhood on New Suffolk Avenue are small nonconforming lots. (b) Many of the lots are long and narrow as is the subject parcel. (c) There are single family dwellings (some with detached garages) throughout the neighborhood. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: (a) With road frontage of only 60 feet, the subject parcel is the narrowest lot in the immediate neighborhood. (b) When built, the original house was angled from the northwest to the southeast. The 1986 C/O states that, in additional to insufficient total area, there is "insufficient side yard area." At that time, the eastern side yard was 12'(see 1983 survey annexed to C/O). (c) The remainder of the existing structure is set back 12'4" or more from the eastern boundary. (d) To enhance the appearance of the rear of the house, a small (1') overhang is proposed on either side of the existing first floor. The result is that the easterly side yard would be reduced to 12'4" - or no closer than the present structure is from the boundary. (e) With the addition, the master bedroom is moved away from heavily traveled New Suffolk Avenue and relocated to the relative privacy of the rear of the existing house. (f) Applicant has endeavored to minimize the nonconformity while enhancing the appearance and privacy of the house. 3. The amount of relief requested is not substantial because the requested 2'8" variance is de minimus in light of the difficulties created by the original siting of the dwelling. • ' Donlin Appeal Application-Page 111 • 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: (a) Most of the neighborhood is made up of improved nonconforming parcels. (b) The proposed addition is at the rear of the dwelling - thereby affording applicant privacy and minimizing the addition's visibility from New Suffolk Avenue. 5. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow a bathroom built into the roof area of the second story with a horizontal ceiling height of approximately 7 feet 2 inches sloping down to 5 feet 61/2 inches on the opposite wall.] FINDINGS OF FACT 1. A proposed new bathroom is to be constructed into the roof area of the second floor of the building that is the subject of this petition. 2. The horizontal ceiling height in the bathroom is approximately 7 feet 2 inches sloping down to 5 feet 6% inches on the opposite wall. 3. With the placement of the fixtures, the ceiling height is adequate for normal usage. 4. The petitioner has proposed to install a fire and smoke detecting devices throughout the new building as required by the Uniform Code. 5. The lot is improved with a single-family dwelling situated 38 feet from the front property line and 12 ft. setbacks on each side, for an existing total (combined sides) at 24 feet. BASIS OF APPLICATION: Building Inspector's May 6, 1999 Notice of Disapproval citing Article III- A, Section 100-30A.3 and 100-244B of the Zoning Code with respect to a proposed 12 ft. by 20 ft. carport at the west side of the existing dwelling with a setback of one foot instead of the Code- required 15 feet, and total combined sides at 13 feet instead of 35 feet. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for a 12 ft. carport at the west side of the existing dwelling with a setback of one foot and a combined setback of 13 feet. (No other areas are noted in the Notice of Disapproval, which is the basis of applicant's request.) REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the alternative relief in this area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties the setbacks at the very least would be three ft. from any property line when locating a detached structure for parking or storing of owner's vehicle. A setback of one ft. is virtually at the property line and would not be in keeping with other:.buildings located in the immediately vicinity. 2. The benefit scrght by applicant can be achieved by some method, feasible for appellant to pursue, other than;the setback of one ft. An alternative minimum setback of three feet may be achieved for a car-Port for owner's vehicle. 3. The requested area variance at a one-ft. setback from property line is substantial and represents a 93 percent reduction from the code requirement from 15 feet. The combined total is substantial with a 37% reduction from the code requirement. 4. No evidence has been submitted to show that the proposed carport would have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district.
