Adriano Property Location: 2195 Edwards Lane, Orient CTM 18-3-6.12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's property contains 65,340 square feet of land area with 260 feet along a private right-of-way, at the end of Edwards Lane in Orient, as shown on the March 21, 2005 survey prepared by Pat. T. Seccafico, Land Surveyor. BASIS OF APPLICATION: Based on applicant's request to amend Building Permit #32026-z issued 5/23/2006, concerning the as-built location of a proposed dwelling at less than 75 feet from the rear yard lot line, the Building Inspector issued a January 22, 2007 Notice of Disapproval citing Section 280-124 and stating that the rear yard setback is 73.5 feet. TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is exempt under Town Code Chapter 268-3(F) because the granting of setbacks in this application is not related to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 22, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant requests a setback variance concerning construction of a new foundation located 73.5 feet, measured from the closest corner. A building permit was issued May 23, 2006 under Building Permit No. 32036-z for a code-required 75 feet from the rear lot line, and the error was not found until the applicant submitted an as-built foundation survey prepared by Pat T. Seccafico to the Building Department. Page 2—March 8,2007 • • ZBA#6006-Ernesto A.Adriano CTM No. 18-3-6.12 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Granting the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The rear of the property adjoins a wooded vacant lot, and the 1.5 ft. setback reduction is not visible. 2. The relief requested amounts to a 1.5 ft. reduction from the code-required 75 feet, which is not substantial. 3. There is no feasible way, other than an area variance, to eliminate the difficulty caused by mistaken placement of the foundation. The cost of removing and replacing the existing foundation would be considerable and little or no benefit would accrue to the applicant. 4. The cited difficulty has been self-created. It was the result of a technical error that yielded no benefit to the applicant. 5. Granting a setback variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. Protrusion of 1.5 feet beyond the required standard setback at one corner of the foundation would have minimal effect on the area. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the as-built foundation survey prepared by Pat T. Seccafico, Land Surveyor. Any deviation from the variance given, such as extensions or a demolition, which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Adriano ZBA File# 6to(o AREA VARIANCE REASONS: (1) Most of the properties in the surrounding area are oversized and wooded. To start with, the back of my property is adjacent to a wooded vacant lot. Survey has been done to have the stake in place in order to locate and lay the down foundation according to variance zoning code. To the best of my knowledge, the work is all done and ready for foundation location survey. Survey has been ordered and completed. The only problem is, it was a foot and a half short to comply with a 75ft zoning variance. The tip corner in the Northwest area of the house foundation protrudes a foot and a half over the 75ft setback from the property line. And the outcome was, we are short a 1.5ft to meet the zoning variance code, but the rest of the rear house foundation in compliance. All I can say, I will not be the judge of whose fault it is, human error was made. It was a technical error, but I do believe, an undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties. (2) Doing so would be senseless, the foundation footings and walls had been laid down. Shaving the tips off from the corner of the Northwest house foundation wall would be impractical. (3) I respect and honor the zoning code variance of 75ft, but error had already been made. Protrusion of a foot and half over the setback will not have a negative effect to the Health, Safety, and Welfare of the neighborhood and community. (4) A foot and a half short from the 75ft zoning variance code requirements will not change the physical or environmental conditions in the neighborhood or district. The corner tips of the rear house foundation that protrudes 1.5ft ruined the required standard setback, but the rest of the rear house foundation is in compliance.
