wife, all residing at Southold, in the Town of Southold, County of
Suffolk, and State of New York,

and ELWOOD L. MARTZ and ALITA L. MARTZ, his wife, both residing at
181-03 Sanford Avenue, Flushing, New York,
parties of the second Part,

ALL that treat or parcel of land, situate, lying and being at Bay
View, near Southold, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point mnrked by a concrete monument at the south-
easterly corner of the premises herein described and at the intersection
of the westerly line of land now or formerly of Edwin H. Brown,.known
as "Cedar Beach Park,” with the northerly line of premises heretofore
conveyed to Elwood L.-Mertz and Alite. L. Martz, his wife, by a certain
dead recorded in the Suffolk County Clerk's Office, in Liber 2974 of
Deeds, at page 564;rtanniag thence North 67 degrees 35 minutes 20
seconds West a distance of 200 feet to a point marked by a concrete
monument; running thence North 36 degrees 27 minutes 30 seconds East
a distance of 202.42 feet to other land of the parties of the first
part; running thence South 67 degrees 35 minutes 20 seconds East a
distance of 200 feet to said land of Brown; running thence South 36
degrees 27 minutes 30 seconds West a distance of 202.42 feet to the
point or place of beginning.
11VGETNER with a right of way over a certain 50-foot private road,
the southerly line of wduloh begins at the southwesterly corner of the
premises herein described and runs South 67 degrees 35 minutes 20
seconds West 414.82 feet to the easterly line of a second 50-foot
private road, and thence along said private road to the easterly side
of Bay View Road.
SUBJECT to any state of facts an accurate survey may show,provided
the same does not render the title thereto unmarketable.
SUBJECT to any state of facts an inspection of the premises would
disclose.
SUBJECT to the following covenants and restrictions:
1. That neither the said parties of the second part, nor their heirs
or assigns, shall or will manufacture, or sell or cause or permit to be
manufactured or sold, on any portion of the premises hereby conveyed,
any goods or merchandise of any kind, and will not carry on, or permit
o be carried on, on any part of said premises, any trade or business
whatsoever, or any boarding house.
2. That no outside toilets or waterclosets will be erected on any
art of said premises.
3. That no dwelling house costing less than $10,000. will be erected
n said premises, garage to be attached and no hedge to be over four (4)
eat high.
4. That no trailers or tents will be kept, used or allowed upon said
remises, except when kept within an enclosed building or garage.
5. No fowl to be kept on said premises.
6. No building is to be erected within twenty (20) feet of any
oundary line of said promisee.
It is understood and agreed.by the parties hereto that conveyances
Of plots 1n the same locality by the parties of the first part shall
contain the same, or similar, restrictions, and that the parties of the
first part will not sell any lots in the neighboring premises owned by
