Rossi For a Variance to the New York State PETITION NO. 2003-0260 Uniform Fire Prevention and Building Code ------------------------------------------------------------- Upon the application of Ronald R. Rossi,filed pursuant to 19 NYCRR 1205 on April 30, 2003, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to alterations to an existing Group Al (one-family dwelling)occupancy, two stories in height, type 5(wood frame)construction, approximately 1,994 square feet in area, located at 51295 Main Road, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.1(a)(2), which requires that habitable space shall have a minimum height of 7 feet 6 inches, except that for habitable space under a sloping roof the minimum height in at least 50 percent of the floor area shall be 7 feet 6 inches and the area where the height is less than five feet shall not be considered in computing required floor area. (The petitioner requests habitable space with a ceiling height less than required.) 9 NYCRR 711.2(b),which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests a corridor and a bathroom with ceiling heights less than required.] FINDINGS OF FACT 1. A bedroom and bathroom were constructed directly under the roof area of the subject building and at this time the owner is filing for a certificate of occupancy. 2. The building is over 100 years in age and is historic in nature. 3. Because of the age of this building, the second story space is limited. There is a second preexisting, nonconforming bedroom on the second story, also located directly under the roof area,with a ceiling height of only 6 feet 8 inches. The ceiling height of the bathroom is 7 feet 10 inches, sloping down to approximately 4 feet 3 inches on the opposite side. 5. With the placement of the fixtures, the ceiling height in the bathroom should be adequate for normal usage. 6. The corridor in question has a ceiling height of 7 feet 10 inches and slopes down to 3 feet 9 inches. The corridor is over 6 feet in width, with approximately 3 feet of the width having a ceiling height of over 7 feet, and should be adequate for travel between the rooms. 7. The bedroom in question has a ceiling height of 6 feet 8 inches for approximately two thirds of the floor area of the room and is similar to the preexisting, nonconforming bedroom that has been used for years. 8. The petitioner has stated that raising the roof to accommodate the required ceiling height would be both physically and financially impractical and would ruin the historic nature of the building. 9. The subject space is in a one-family dwelling, used by individuals who are accustomed to their surroundings, and the ceiling heights of the rooms in question will not have a substantial negative effect on their health or life safety. 10. The petitioner has proposed to install interconnected smoke-detecting alarm devices throughout the entire building. it. The petitioner has proposed that the alterations will meet all other applicable provisions of the Uniform Code. 12. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.1(a)(2), to allow habitable space with a ceiling height less than required, and 711.2(b), to allow a corridor and a bathroom with ceiling heights less than required, be and are hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner install interconnected smoke-detecting alarm devices throughout the entire building. 2. That the alterations will meet all other applicable provisions of the Uniform Code. This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
