It has been over three years since you filed yovr site plan application in August of 1989. As indicated my letter to you of January 29, 1992, (copy enclosed), drainage calculations must be shown on the amended plan in addition to a change in scale from 1" = 40' to l' = 20 ' Health Department review will also be required before the Chairman can endorse the plan and recommend issuance of a Certificate of Occupancy by the Principal Building Inspector. Murphy, Supervisor FROM: Valerie Scopaz, Town Planner DATE: October 5, 1989 RE: Request for Status of Van Duzer Application to the Planning Board On August 31, the Planning Board received a site plan application from Robert Moeller to build a new building on the site of Van Duzer Gas Service, Inc. Upon review of the application, it was discovered that part of the proposed building would lie within the residentially zoned portion (and outside of the business zoned portion) of his property. Changes would have to be made to the site plan to bring it into compliance with the Code. Mr. Moeller was notified of this by letter dated September 12, 1989. A copy is enclosed for your reference. This letter also referred to other information that was missing from the site plan. Mr. Moeller subsequently contacted the Town Attorney, who was informed of the above. The Planning Board has reviewed the proposal and has endorsed either one of two options. The first option would be for the proposed building to be moved south so that it lies within the residential zone. This is unacceptable to Mr. Moeller because of the physical setup of the propane tanks. Also, the proposed building's foundation has already been installed without benefit of a building permit. The second option would be for Mr. Moeller to apply for a change of zone on part of his property. The enclosed sketch indicates the change that the Board would endorse.
