Dear Mr. Hydell:
The following resolutions were adopted by the Southold Town
Planning Board at a meeting held on Monday, April 9, 1990.
RESOLVED that the Southold Town Planning Board, acting
under the State Environmental Quality Review Act, do an
uncoordinated review of this unlisted action. The Planning
Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-significance and grants a Negative
Declaration.
WHEREAS, John P. Krupski and Brothers Incorporated are the
owners of the property known and designated as SCTM# 1000-74-4-5
located on County Route Forty Eight (48) and Paul's Lane,
Peconic, Southold; and
WHEREAS, a formal application for the approval of this
amended site plan was submitted on March 16, 1990; and
WHEREAS, all the requirements of the Site Plan Regulations
of the Town of Southold have been met; and
be it therefore,
RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated March
29, 1990.

As reported to you in a memo dated December 2, 2002, this operation is in
violation of an approved site plan condition. I have requested voluntary
compliance to no avail.
Town Code section 100-253G provides for a legal remedy to this type of violation
it states ;
Upon recommendation of the Planning Board and approval of the Town
Attorney, the Building Inspector may revoke an existing certificate of
occupancy upon a showing that the subject premises is being occupied or
used in violation of an approved site plan and may direct that such
occupancy or use be discontinued. The Town Attorney is authorized to
commence proceedings in a court of appropriate jurisdiction to restrain
said use or occupancy.
The Planning Board needs to initiate this action through the Town Attorney's
office. I remain available to conduct any further investigation, produce evidence
as may be required.

The above referenced operation is violation a condition of their approved site
plan. Specifically, the display of items in a location prohibited by the approved
plan. In the past I have contacted the operator regarding this condition and
advised him to apply for and amendment or comply. Obviously, neither has taken
place.

RE: North Fork Wood Design
In response to a request from the Planning Board staff, I
visited the site of the above referenced business. The complaint
was that the setback condition of the approved site plan was not
being complied with. I have been to this location in the past on
the same complaint and the owner had always complied. At this
time the display items have once again been placed in the
setback area. The owner has not moved them to date and they
remain in violation of the condition of the approved plan.

As discussed today at Town Hall, the Planning Board is
requesting an "as built" site plan for your new addition.
The fOllowing changes must be made on the map dated March
16, 1990:
The set back line for the storage area should be a
continuation of the North 64.00 East 195.50 line to
the western boundary of the property as shown on the
enclosed map.
Other changes are indicated on the enclosed map.
Upon receipt of the map with the requested changes the
Board will update its records.

The Building Department has certified the above mentioned
site plan (see enclosed).
Prior to action by the Planning Board, the Board requests
that the surveys be amended as follows:
1. Delete the proposed deck since this would not meet the
zoning requirements.
2. Delete the access out to County Route 48.
3. Indicate a storage area 250' back from County Route 48.
Upon receipt of an amended site plan as per the above,
the Board can place this matter on the agenda.

Dear Supervisor Murphy:
A copy of a letter dated February 17, 1987 addressed to you by Andreas E. Markakis
has been turned over to me by my client, North Fork Wood Design.
My office is not involved in the actual process of obtaining permits, etc. for the
company but was ret ained by them to represent them in a claim that Mr. Markakis
had for rent that he alleged was due to him for the rental of a building in Riverhead.
A copy of the pertinent correspondence is enclosed and my reply thereto which
I think sheds some light on why Mr .Markakis choose to send you his letter. I had
previously received a call from the attorney handling the matter advising that
a letter of complaint would be filed if payment of the rent was not received.
The matter will be litgated in the Courts and it is unfortunate that Mr. Markakis
is trying to accomplish through your office what he can't accomplish in Court.
As for as I know from Mr. Hydell, the present location of the company is in {]
Commercial Zone and all that is required is Site-Plan approval from the Planing
Board. The survey has been completed by Mr. VanTuyl and the necessary applications
should be before the Planing Board by the end of the week.

Re: Compass Transports vs. Hydell
Dear Mr. Price:
Your letter of January 14, 1987 has been turned over to me by Mr.
Hydell for a reply. Based on the facts that have been related to
me by Mr. Hydell, it would appear that a landlord/tenant
relationship was never established.
From what I understand, the parties wished to enter into a lease
agreement, however, zoning requirements did not permit the use of
the premises for the purposes intended. Applications were
required for the necessary permits from the Town of Riverhead and
your client was not willing to hold the premises unless he was
paid $1,000.00 a month for keeping the premises off the market.
At best, we have an option, or possibly an agreement to agree,
both of which are unenforcable.
The requirements as finally submitted to Mr. Hydellby the Town of
Riverhead were prohibitive, not only in cost but in time. He was
told that it would take at least six months in order to obtain
the necessary permits and use change.
Mr. Markakis was informed of this action by the Town of
Riverhead, and was in fact notified that a lease would be out of
the question.
I do not see where any money would be due to him for January, and
disagree with your conclusion that rent will continue to become
due each month. Your client was paid what he wanted and I think
any further demands for payment are unjustified.
In the meantime', my client, at the specific instance and request
of your client, installed 200 feet of fence and repaired his
garage door for a total amount due of $2,741.25. I understand
that a bill has been furnished to you for that amount and I would
appreciate you client's check for that amount made payable to
North Fork Wood Design and sent in care of my office. Thank you.
