RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, do an uncoordinated review of this unlisted action. The Planning Board establishes itself as Lead Agency, and as Lead Agency makes a determination of non-significance and grants a Negative Declaration. WHEREAS, John P. Krupski and Brothers Incorporated are the owners of the property known and designated as SCTM# 1000-74-4-5 located on County Route Forty Eight (48) and Paul's Lane, Peconic, Southold; and WHEREAS, a formal application for the approval of this amended site plan was submitted on March 16, 1990; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; and be it therefore, RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated March 29, 1990. . . My office is not involved in the actual process of obtaining permits, etc. for the company but was ret ained by them to represent them in a claim that Mr. Markakis had for rent that he alleged was due to him for the rental of a building in Riverhead. A copy of the pertinent correspondence is enclosed and my reply thereto which I think sheds some light on why Mr .Markakis choose to send you his letter. I had previously received a call from the attorney handling the matter advising that a letter of complaint would be filed if payment of the rent was not received. The matter will be litgated in the Courts and it is unfortunate that Mr. Markakis is trying to accomplish through your office what he can't accomplish in Court. Re: Compass Transports vs. Hydell Dear Mr. Price: Your letter of January 14, 1987 has been turned over to me by Mr. Hydell for a reply. Based on the facts that have been related to me by Mr. Hydell, it would appear that a landlord/tenant relationship was never established. From what I understand, the parties wished to enter into a lease agreement, however, zoning requirements did not permit the use of the premises for the purposes intended. Applications were required for the necessary permits from the Town of Riverhead and your client was not willing to hold the premises unless he was paid $1,000.00 a month for keeping the premises off the market. At best, we have an option, or possibly an agreement to agree, both of which are unenforcable. The requirements as finally submitted to Mr. Hydellby the Town of Riverhead were prohibitive, not only in cost but in time. He was told that it would take at least six months in order to obtain the necessary permits and use change. Mr. Markakis was informed of this action by the Town of Riverhead, and was in fact notified that a lease would be out of the question. I do not see where any money would be due to him for January, and disagree with your conclusion that rent will continue to become due each month. Your client was paid what he wanted and I think any further demands for payment are unjustified. In the meantime', my client, at the specific instance and request of your client, installed 200 feet of fence and repaired his garage door for a total amount due of $2,741.25. I understand that a bill has been furnished to you for that amount and I would appreciate you client's check for that amount made payable to North Fork Wood Design and sent in care of my office.
