Dear Mr. Cron:
A field inspection was made on the above referenced
property on December 14, 1979, attended by Howard Young, Bennett
Orlowski, Jr. and Henry Raynor, Jr.
It was agreed that this property should be developed as
a cluster subdivision. The area in the low meadow cannot be
used in the computation. There should be no lots below the
fourteen foot contour. Mr. Young indicated that the lots may
be in a position to conform by moving them to the east.

A regular meeting of the Southold Town (Planning Board was
held ;on June 5, 1978- `At that time I informed the Board
that .you had requested information on what comments and
recommendations of Lawrence M. Tuthill' s letter of April
17th must be adhered 'to.
It was .the consensus of the Board that the 'developer comply
with all the recommendationsandcomments with the
exception of CoAment '1. It is understood that the developer
will eliminate the two lots that are under water from the
subdivision.

Dear Sirss Rei Cutchogue Joint Ventures
Having now had time to study the revised plan proposed for
development of the property on Route 25 known as Cutchogue
Joint Ventures and, subsequently having examined this
property and adjacent properties on foot, I would like to
call the Planning Board's attention to a number of very
basic needs which have not been met in the revised proposal.
Whereas the presentation at the most recent preliminary
hearing included the statement that drainage problems along
the western side have been solved by the revisions, the fact
is that the new plan actually accentuates, in several major
ways , the extent to which development of the property would
divert drainage water in massive quantity onto the adjacent
property to the Blest.
The new plan proposes filling Lot 5 almost out to the west-
ern property line. This would clearly block the natural
flow of water which drains off of farmland far to the north
and ends up in this bottom land area. IdIore importantly, it
would remove completely a major portion of the existing
reservoir area which contains this drainage water. The
water in this reservoir represents the water table level and
it does not recede below ground level until the typical
5-6 week drought in mid summer. The drainage water reservoir
now covers 100-150' of the western portion of this 270' Lot 5
for 5-6 months almost every year. The unavoidable result
of the filling of Lot 5 would be to flood the unflooded areas
to the west including the only access road (paved) to the
nursery production area to the north west. This road was
raised to an elevation which keeps it open and accessible
but access could not possibly be maintained under the filling
of Lot 5 - nor could the long existing pasture to the west
be maintained in useable condition.
The proposed drainage pond in the southwest corner of
Cutchogue Joint Ventures would have an equally disastrous
effect on the remaining bottom land and access road. It
would be graded up on all sides and designed to take water
only from the proposed roads to the East, whereas this entire
area is now the principal reservoir area for drainage water
from the north. Currently (typical for this time of year)
an estimated 1.4 acres of this "set aside" area is under
water and here the present water reservoir now ends almost
exactly at the western property line of Cutchogue Joint Ventures.
The effect of installation of the drainage pond would be to

force this water onto the adjoining hay field (of many
years standing) and over the access road.
The north west corner section of Cutchogue Joint Ventures
(roughly 2 acres ) currently drains off onto the adjacent
western property at the very northwest corner. This water
then flows south in a soil consdrvation plan diversion ditch
into the very residuary reservoir at Lot 5 which Cutchogue
Joint Ventures proposes to fill. Thus, tha revised plan
takes a'wa.,y the very residuary basin which not hold its
own drainage water. r,:oreover with this N.W. corner developed
and housed and paved, considerable additional drainage water,
now absorbed by the open farm fields, would be forthcoming.
The south west section of Cutchogue Joint Ventures, an area
of 62-7 acres currently drains off ( in annual gully eroding
quantities) right at the south west ( inside) corner formed
by the jog to the east along the George Alec property. This
water generally flows into the residuary reservoir proposed
for an embanked and restricted drainage pond. When the
quantity of water is especially large it splits with part
going across the Alec property and into the pond next to
Route 25. No provision has been made to control this water
other than what the proposed road system would capture and
divert into the proposed drainage pond. Even if the roads
were able to capture all water to the North and East of the
road system, there would be three acres of drainage wanting
to go into a reservoir that would be eliminated by the
proposed drainage pond.
Uther important faults in the revised xlan are:
It does not meet the `mown requirement on set aside
land which should be l acres. _he ,)lar. says 70,000
sq. ft. are set aside but if you measure the area East
of the top ridge of the proposed drainage pond it seems
to be more like 47,000 sq. ft. at most and this includes!
area which will be under water.
It does not meet the Town requirement for two roads
in and out where over 20 lots are involved.
It does not provide for remedy of drainage in the major
depression in the Nort:i central section . ots 16, 17,
16 ar_d 19 ) . Although this depression lays high and does
not contain water for lona periods, it drains an apprec-
iable section of the Cutchogue Joint Ventures and in-
variablil, fills with water after a heavy rainstorm. The
water collection portion of this depression is irregular
but e�:.tends 200' north to south and 1501 east to west.
With the additional runoff from houses and driveways ,
Lot 16 and possibly more of these lots would provide
serious trouble for the unsaAspecting owner long after
the sellers have Fone .

Presumably you will recall at the Planning Board meet-
ing we requested a letter from the Planning Board informing

is adopting for this particular subdivision. We are unable
to proceed with any map revisions until we are advised in
writing a s to what changes the Board insists upon.

Dear Mr. Wickham:
In accordance with your request the staff has examined the proposed subdivision
layout for a 30.345 acre tract reputedly owned by Cutchogue Joint Venture and offer
the following comments on the map for your use.
The proposed subdivision layout relative to County, Federal, and State roads,
properties and proposals appears to be satisfactory. However, the final map should
bear a note that prohibits vehicular ingress and egress to Main Road from Lot 1.
Also, the driveway for Lot 1 should be located as close to the lot line for Lot 2
as possible. Both of these measures will help to protect the traffic safety and
carrying capacity of the State road by minimizing the number of access points and
by providing sufficient storage area for vehicles to slow down and stop when a
vehicle is entering the driveway on Road A.
The proposed drainage pond appears to be an excellent idea and it should help
to create a natural looking area while providing for the disposal of stormwater run-
off. It is suggested that the proposed grading of Lot 1 be modified to give the
area a more natural look and also provide more useable lot area within Lot 1. It is
suggested that a check be made into the possibility of any legal problems arising
out of the discharge of overflow as proposed as the overflow may enter the adjoining
property. It may be advisable to locate the overflow so that it will discharge into
the natural runoff channel to overcome any objections relative to alteration of
natural flow patterns.
Staff comments on a preliminary map do not constitute a review of the map by
the Suffolk County Planning Commission. When the map has been finalized it should
be referred to the Commission for review pursuant to Section 1333 of the Suffolk
County Charter.

Planning Board at a regular meeting held May 15, 1978.
RESOLVED to disapprove the preliminary map )f the
subdivision to be known as "Cutchogue Joint Venture"
for the following reasons:
1. Pursuant to Article III Section A106-36 C. lots
5 and 6 cannot be deemed platable property because they
are under water.
2. Using the drainage area as indicated on the map
would result in forcing of storm water over onto the .

There is a major objection to approval of the development plan
of Cutchogue Joint Ventures with which the Plannin_; Board is
already very familiar. The bulk of this property is prime
land for agricultural production. It is the type of land which
is supposed to be preserved under Town policy. Even if this
were not the case , development of this land makes no sense in
terms of the short term needs or long tern nerd., of a`Out'zold
,own or �uffc].',c County, or INew York State . There is a backlog
of already approved subdivisions sufficient to meet housing:
needs well into the future . i�.oreover, it presumably has been
established that the housing potential on the fringes of prime
agricultural land will take care of the future _opulation which
can be supported with the available water supply.
The plea of the "rights" of the present speculator owners (or
any owner) is subject to very serious question. ,]here in the
Common Law or its modern day extensions does one find that a
person has the inherent "right" to destroy irretrievably for
all future ,generations a basic resource which was created long
before any of our forebears were born?
At some point of time in the development of our society, we have
to face the fact that we have lacked a sound philosophy which
deals with the longer term question of our responsibilities to
those who come after us . For Eastern Long Island's unique farm
land , that point of time is now. The future consequences of
our failing to adopt a workable policy with some foresight
beyond our current purse strings , are tremendous . I am sure
that ,you all know better than I that, by allowing unusually
productive agricultural land to be housed over, we are creating-
hardships beyond measure for our children and their children.

Dear Muriel:
In connection withthe above-captioned subdivision, we
submit herewith application for approval of plat, in dupli-
cate, together with check payable to the Town of Southold
in the sum of $205. 00, representing the required filing fee.
We are also annexing to the application, in duplicate, a
description of the premises as contained in the deed of con-
veyance which description is in accord with the survey of the
proposed subdivision.
If all is satisfactory, we should appreciate if a pre-
liminary public hearing on the proposed subdivision were
scheduled as soon as possible.

"Cutchogue Joint Venture" by Young and Young dated August 24, 1977.
The soil and drainage conditions as depicted on the Suffolk County Soil -
Survey are:
Soils: The majority of the higher ground in the plot is Haven Loams on
0- percent slopes. The southwest corner of the property is Riverhead
Sandy Loam on 0-8 percent slopes. Both of these soils are considered
prime agricultural land by the USDA, Soil Conservation Service. The de-
pressed area in the central part of the property is Plymouth Loamy Sand
on 3-8 percent slopes. On the Plymouth and Haven Sails, I would expect
a gravelly sand at a depth of two-two and half feet, The depressed area
Is probably, at present, slowly permeable compared to most Plymouth Soils
due to erosion of silt soil particles from the surrounding Haven Soils
into the depression thus, clogging the more porous Plymouth Sands.
The western edge of the property is composed of Carver-Plymouth Sands on
the steep embankment dropping to the flood plain which is also Carver-
Plymouth Sands. Carver-Plymouth Sands usually indicate a drainage way
where, over the years, the fine soil particles have been eroded away.
Drainage: The southwest corner of this property just above the pond on
the James Cross property is a fresh water marsh containing cattails, bul-
rush, and three square. The marsh is the concentration point for runoff
water that originates north of Oregon Road: see attached map. Under cur-
rent agricultural usuage the drainage area will contribute small amounts
of runoff to the pond. Frozen conditions, however, can produce significant
runoff to this point exceeding the capacity of the road culvert under Route ,
25, thereby flooding the pond-marsh area,
As indicated by the letter from James Cross, this marsh-pond area is sub-
ject to flooding during the winter and spring months. Any modification
of this parcel of land that may interfere with the existing drainage pat-
tern can only aggravate this situation. _
At this point, I cannot review the plan with regards to its acceptability
without a drainage and erosion and sediment control plans to protect the

marsh-pond area. I do feel , however, that a drainage plan should contain
several considerations. These include:
1) No modification of the areas identified as CpA and CpE (Carver-
Plymouth) or RdB (Riverhead) Soils. These areas should remain
open to allow for storage of the runoff from the existing drain-
age system.
2) The proposed road between Lot r#5 and park-recreation area should
be eliminated. This road follows a major drainage channel accel-
erating the disposal of water off the property. The development
drainage plan should not increase the quantity of storm water
running off as compared to undeveloped conditions.
3) An adequate drainage plan cannot be developed without an accurate
topographic survey. The sketch plan identifies contours at five
foot intervals as shown on the USGS, Mattituck Hills, NY Quad
dated 1956. We had found these contour maps, due to the small
scale, inadequate for specific site planning. A two foot contour
map is recommended.
4) The depressed area in the central portion of the property could be
used as a vertical sand drain to dispose of the storm water runoff.
To do so, the roads and lots would have to be relocated to provide
grade for a drainage system disposing of water here.
5) An alternative drainage system is the sand recharge swale concept.
This concept is constrainted by its requirement for open sand swales
along the road. This swale is considered unaesthetic and needs a
homeowners association for continued maintenance, two factors that
Interfere with sales of the lots.

The following information should be taken into most serious
consideration with regard to the application of the Cutchogue
Joint Venture for a subdivision on the north side of Route
25 about one mile west of Cutchogue.
The plas as presented includes approximately three acres of
natural wetlands in the southwest corner. This area is the
final drainage basin for many acres of farmland to the north
and to the east. The runoff from several farms is absorbed
by this bottom area beginning with the fall rains then build-
ing up rapidly when frost is in the ground and culminating
upon the completion of the spring rainy period. At this point
the area is completely covered with water, the level being
that of the ground water tqble . At some point each spring the
basin is completely full with the excess going into the pond
to the south. In three years of the past ten, the pond on
Route 25, this 3 acre low area and the adjacent low ground to
the west became one uninterupted body of water.
Water covers significant portions of this three acre section
through June and into July depending upon when the first
extended summer drought of four or five weeks occurs. The wild
ducksLand the herons feed exactly in this area every year until
VLeS July. One small section contains water the year around in two
years out of three.
The original plan for subdivision sets aside the most southwest
part of this three acre area for drainage. The extent to which
the land immediately north of this designated drainage also
dncompasses this same low land (and the lowest of all) can be
seen by the following approximate measurements from the stakes
recently placed at the Planning Board's request -(all from the
western property line of Cutchogue Joint Venture)

If this portion of the wetlands were filled for building
or cesspool clearance or otherwise, the designated drainage
area would be meaningless because the fill would lie between
the source of the runoff water and the area designated for
drainage . Moreover, the total quantity of any season's
runoff would be illegally diverted onto the property immediat-
ely to the West. This property 'now shares the total drain-
age basin and will continue to do so but the capacity is
inadequate for the total runoff and considerable property
now in pasture and the only access road to this adjacent
property would be put under water every year.
A five minute visual survey of this area would reveal the
inappropriateness of the plan as now proposed.
