It is our understanding that you will be reviewing the file
for the above premises today. The following information is
provided for the record and your reference:
Our home is located immediately to the west of the above
referenced parcel. Both the absentee owner/McKay (applicant)
and current tenants/Carbonetta, have been made aware of
certain conditions which are in need of resolution, to no
avail. The downside of granting approvals to absentee
owners, on behalf of their tenants, has manifested itself in
many ways in this instance; i.e., the property has been
strewn with household garbage, derelict vehicles, (including
boats, campers, abandoned cars, tires, salvage building
materials, appliances, etc.) and ripped plastic sheeting
hanging from exterior windows.
Since the farmstand has been operational (c. 1994), DQ
off-street oarkinq has been provided. As per parking sketch
located in your files, it is my understanding that the Board
previously approved the farmstand use with four (4) parking
spaces on the eastside of their easterly driveway. Now, it
presently appears that a parking area is being developed on
their west property line, immediately adjacent our only
access (see attached sketch) . We strongly object to this
possibility, as farmstand patrons regularly park vehicles
directly in front of our driveway and along the shoulder of
the road, obstructing vision and preventing egress or
ingress. As you can see, approval of any parking in this
area will intensify an already difficult and hazardous
condition.

In addition, during this past year, we have had three
potential accidents (in full view of the tenants), because
our easterly line-of-sight to Rt. 25 is totally obstructed by
the display of plants, agricultural products and two
oversized A-frame signs, all within 10' of the pavement.
This extremely dangerous and unacceptable condition is not
permitted by Town Code and is prohibited by NYS Vehicle and
Safety Laws. Despite the fact that the current Code Enforcer
has informed the far~stand operators that the signage and
displays were not code compliant and must be moved, they have
brazenly defied any such direction as of this date.
Furthermore, their detached garage is used on a daily basis
as either a woodworking shop or vehicle repair facility.
Since this garage is virtually on our common property lines,
in full sight and sound of the bedrooms and rearyard of our
home, the machinery, gasoline odors and loud vehicle noises
(unmuffled motorcycle "trike", of late) emanating from this
structure, have denied us enjoyment of our residence for
quite some time, not to mention the negative impact on our
property value (specifically addressed in the Code) . Is the
above together with the aforementioned "farmstand" use not an
example of multiple home occupations?
This "farmstand" operates more like an all-day, year-round
Yard Sale, since furniture, consignment firewood, wall
hangings and wooden lawn ornaments (manufactured in the
detached garage) are sold with some agricultural products.
It is incumbent upon the Board to consider the impact of its
decisions on neighboring properties. In light of this, we
respectfully . request that the Planning Board take necessary
actions to assure compliance with all relevant Town Codes,
including but not limited to, multiple home occupations,
signage, and product sales/display. It is our position that
absolutely no consideration be given to relocation of
off-street parking previously approved. A field visit may
provide better insight into all the above issues.
