consideration paid by the party of the second part, does hereby grant and release unto the patty of
the second part, the heirs or successors and assigns of the patty of the second part forever, a legal
life estate in and to
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being at Cutchogue, in the Town of Southold, County of Suffolk. and Slate of New
York, being more particularly bounded and d~cribed as follows:
Bounded on the North by Depot Lane, 70 feet;
Bounded on the East by lands now or formerly of Cybulski, 187 feet;
Bounded on the South by lands now or formerly of Cybulski, 70 feet; and
Bounded on the West by lands now or formerly of Trois Ange LLC. 187 feet.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the lust part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument.

party of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
TOGETHER' with' all right, title and interest, if any, of the party of the first pa~ in and to any

with the appurtenances and all the estate and rights of the pa~y of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second

AND thc party of the first pa~ covenants that the pa~y of the first part h.a~ not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
afuresaid.
AND the party of the first part, in compliance with Section 13 of thc Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the fight
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
