STEVE VESEY and CHERYL SCHLITT #5529. Request for an Interpretation of Sections 100-242A and 100-
(JD)
244, reversing the Building Inspector’s April 9, 2004 Notice of Disapproval, and/or in the Alternative a Variance
concerning proposed additions to the existing dwelling with total side yards at less than 35 feet, and a single
side yard at less than the code required 20 feet. Location: 370 Dogwood Lane, East Marion; CTM 38-5-3.
Pending Deliberations/Decisions (hearings concluded 6/22/04):
DEBRA VICTOROFF #5334. Request for a Variance under Section 100-244, based on the Building Department
February 11, 2003 Notice of Disapproval, amended April 20, 2004. Applicant proposes a dwelling less than 35
feet from the front property line and less than 35 feet from the rear lot line, at 445 and 505 Dogwood Lane,
Southold; CTM #54-5-55 & 29.1 (as one lot).
JOAN A. SAUNDERS #5537. Request for a Variance under Section 100-92, based on the Building Department’s
January 20, 2004 Notice of Disapproval. The applicant is proposing a lot with an area of less than 20,000 sq. ft.,
in a pending lot line change application, with a single side at less than 10 feet and total side yards at less than 25
feet. Location of Property: 1095 Franklinville Road, Laurel; CTM 125-2-3.1 and 4.1.
JEANNE VANBERGEN #5535. Request for a Variance under Sections 100-242A and 100-244, based on the
Building Department's March 31, 2004 Notice of Disapproval, concerning a proposed addition. The reasons
stated are that Section 100-242A and Interpretation in Appeal #5309 does not permit new nonconformance or
increase in the degree of nonconformance, and Section 100-244 requires a minimum front yard setback of 35
feet. Location of Property: 555 Horton Avenue, Mattituck; CTM 141-1-26.
DAVID AND JANE STARWOOD #5534. Request for a Variance under Section 100-239.4B, based on the Building
Department's April 8, 2004 Notice of Disapproval, concerning an as-built deck addition at less than 75 feet from
the bulkhead, at 175 Sun Lane, Southold; CTM 76-1-13.
ELEFTERIOS MOUROUNAS #5543. Request for a Variance under Sections 100-242A and 100-244, based on the
Building Department’s April 5, 2004 Notice of Disapproval concerning a proposed addition to the dwelling
existing in a nonconforming location. The reasons stated are that Section 100-242A and Interpretation in Appeal
#5309 does not permit new nonconformance or increase the degree of nonconformance, and Section 100-244
requires a minimum 35 ft. front setback. Location of Property: 985 Central Drive, Mattituck; CTM 106-2-27.
