Fax (631) 765-9064 RECEIVED "t~~;J3% JAN 2 9 2007 a~5~C1.~,_'J_~, S~lhord TOWd (Ierl FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JANUARY 11, 2007 ZB File No. 5983 - NOFO PROPERTIES LLC, MARK GORDON, ELLIE GORDON Property Location: 1150 Northview Drive, Orient CTM 13-1-1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 69,195 sq. ft. parcel has 124.41 feet along North View Drive and is improved with a single-family dwelling as shown on survey prepared by John A. Ingegno, Land Surveyor dated 12/2/04, amended June 8, 2006. BASIS OF APPLICATION: Request for a Variance under Section 280-116, based on an application for a building permit and the Building Inspector's August 21, 2006 Notice of Disapproval concerning proposed additions and alterations to the existing dwelling at less than 100 feet from the top of the bluff adjacent to the Long Island Sound. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated December 15, 2006 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: A recommendation under Chapter 268 (95) of the Town Code was submitted to the Board of Appeals in a letter dated November 29, 2006 from Mark Terry, LWRP Coordinator, concerning the applicant's proposed additions and alterations. The recommendation stated that the project was inconsistent with the policy standards and the LWRP, and it was recommended that the application be amended to meet the minimum setback under Chapter 275. The applicants propose an open deck and step area, after demolishing the existing deck and step area. The location is very similar to the existing deck. The construction will be modified to correct flat roof pitches, and the building codes require scuppers, gutters and leaders and drywells to be installed. The Board of Appeals has conditioned this determination with the requirement that a complete drywell system be installed south of the property to ensure proper drainage on site and avoid rain/groundwater runoff toward the bluff (determined by the Building Inspector, as per code). It is determined, therefore, that that the project is not unreasonable since the new deck construction will be placed on footings and the above-ground construction will be open Page 2 - January 11, 2007 - ZB File No, 5983 - No Fa Properties~, Mark Gordon, Ellie Gordon CTM No. 13-1-1 . to the sky, with step area on the north side of the dwelling, similar to the existing deck area, and not unreasonable when there is no other land area available that would provide a greater reasonable degree of setback conformity. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant/owner requests a setback variance, following demolition of an existing deck and stairs that are in disrepair, to build a new larger deck and stairs that will be located 39' 2" from the top of the bluff instead of the code required 100 feet. Other additions and alterations include creating two exterior decks on the existing flat roof with code required railings, accessed by code compliant exterior stairs that will replace existing exterior stairs. A rhomboid-shaped second level room addition is proposed on the existing flat roof, consisting of two walls at +/-15 feet in length and a third wall at +/-6 feet in length. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed deck is not visible to any neighbors or from the private access road. It is modest in size and appropriate to the architectural style of the existing dwelling. Both the new deck/stairs and additional exterior stairs leading to two roof decks with railings will be repaired and/or replaced to bring them up to code. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because any construction on the north side of the existing house will be less than the code required 100 feet from the bluff adjacent to Long Island Sound. 3. The variance granted herein is not substantial. The proposed deck will decrease the existing setback from the bluff by 6' 6" as noted on the architectural plans for the Gordon Residence drawn and stamped by Stageberg Architecture dated 10-17-06. The lip of the bluff is curvilinear and the exact setback distance will vary according to the point from which it is measured. Other additions/alterations are within the existing footprint/building envelope and will not alter the height of the existing dwelling. The owner/applicant testified at a Public Hearing on December 28, 2006 that the engineer's report that he ordered indicates that no changes in the foundation or structural system of the existing dwelling appear to be necessary. Some interior demolition is planned. 4. The alleged difficulty has been self-created because the owner/applicant is proposing to construct a new and larger exterior deck and room addition which will increase the degree of non-conformity of this pre-existing non-conforming dwelling. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. New deck footings will not adversely impact the bluff. The seaward side of the subject property is landscaped with grass and trees that will mitigate runoff. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enlarged exterior deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared by John A. Ingegno, Land Surveyor dated 12/2/04 and the 10-17-2007 site and elevation diagrams prepared by Stageberg Architecture PLLC, subject to the following conditions: 1. All exterior decks at ground level and roof level shall remain open to the sky as noted on the architectural plans for the Gordon Residence drawn and stamped by Stageberg Architecture dated 10-17-06 2. That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
