LOCKRIDGE, Owner and Applicant Location of Property: 9625 Main Road, East Marion CTM Parcel # 31-3-21 REQUEST MADE BY APPLICANT: This is a request for a Special Exception under Section 280- 14B of the Southold Town Zoning Code by the owner to establish a Bed and Breakfast use as an accessory use incidental to her residency in the existing single-family dwelling. The applicant is proposing the occasional renting of three (3) guest rooms for lodging and serving of breakfast to six (6) casual, transient roomers. PROPERTY DESCRIPTION: The applicant's property consists of approximately .75 of an acre located on the north side of the Main Road (a/Ida NYS Route 25), and is improved with a two-story, single-family dwelling and accessory buildings, shown on the March 1, 1982 survey prepared by Roderick VanTuyl, P.C. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 22, 2007, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Dorothy E. Lockridge is the applicant herein and has resided in the home since her purchase of the property on February 13, 2006 from Patricia Garabrant. The applicant has furnished a copy of the July 8, 2002 Certificate of Occupancy for the preexisting dwelling. The applicant will continue to occupy the dwelling as a principal residence while operating the proposed accessory use/B&B which will consist of three guest rooms. 2. The accessory Bed-and Breakfast use is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. The applicant has provided information to show the on-site parking will be behind the dwelling in the rear yard area, with access through a driveway along the westerly side of the property. 3. This special exception use will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. 4. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, or the order of the Town would be adversely affected. Page 2 - March 8, 2007 ZBA #5997 - Dorothy E. A Certificate of Compliance or similar document is necessary for issuance by the Building Inspector certifying that the premises conforms to applicable codes for an Bed-and-Breakfast use and under Zoning Code Sections 280-17 and 280-14B (a-d). BOARD ACTION/RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B and the Code of the Town of Southold, Chapter 280, the following action was taken: On motion by Member Goehringer, seconded by Member Oliva, it was RESOLVED, to GRANT the application for an Accessory Bed and Breakfast Use as described above, SUBJECT TO THE FOLLOWING CONDITIONS: 1) A minimum of five (5) parking spaces shall be on-site on this property as per code (three for the Bed and Breakfast Use and two for the single-family dwelling). 2) Applicant-Owner shall occupy the dwelling as her principal residence. 3) This Authorization is issued solely for an Accessory Bed and Breakfast and does not include use of the lot and buildings for any other use or purpose. 4) The owners-applicant shall obtain a B & B permit from the Town of Southold Building Department as required by Code Section 280-13(B) before occupancy of the Bed and Breakfast rooms. 5) There shall be no backing out of cars onto Route 25. 6) There shall be a flexible ladder placed next to each guest bedroom for emergency purposes. 7) The Board of Appeals reserves the right to visit the dwelling regarding this determination. 8) Parking must at all times be placed in the rear yard area. 9) A sign shall be placed in a very conspicuous place within or along the driveway area to indicate to drivers that there shall be no backing out onto State Route 25. 10) A sign shall be placed along the driveway facing those exiting the driveway indicating 'No Left Turn!' FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 14, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. REASONS FOR BOARD ACTION, DESCRIBBELOW: Based on the testimony and record before the Board and personal Inspection,the Board makes the following findings: 1. This use as requested is reasonable in relation to the District in which Is located, adjacent use districts, and nearby and adjacent residential uses.
