Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OFJANUARY 11, 2007 ZB File No. 5960 - Joan and Harold Kiefer Property Location: 1115 Terry Lane, Orient CTM 14-3-3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' 67,214 sq. ft. parcel is 150 feet wide and 443.27 feet in depth, and is improved with a single-family dwelling as shown on survey prepared by John C. Ehlers on 4/28/00. BASIS OF APPLICATION: Request for a Variance under Section 280-116, based on the Building Inspector's July 14, 2006 Notice of Disapproval concerning a proposed deck addition at less than the code-required 100 ft. minimum setback from top of bluff adjacent to the Long Island Sound. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated December 15, 2006 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application was referred by the Zoning Board of Appeals as required under Chapter 268. In addition, the applicants have obtained a permit dated June 21, 2006 with authorization from the South old Board of Town Trustees and Letter of Consistency. As part of any approval of this variance, the top of the bluff shall continue to be maintained and completely vegetated with turf grasses and new plantings, and roof runoff water shall continue to be collected in gutters and discharged into the ground through downspouts and drywells. In addition, information was received from the Suffolk County Soil and Water Conservation District in its letter dated October 13, 2006 indicating that the bluff appears stable for the purpose of adding an uncovered one-story deck. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, > - Page 2 - January 11, 2007 ZB File No. 5960 - Joan and Harol efer CTM No. 14-3-3 . personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 19'4" open (uncovered) deck extending from the north side of the dwelling, with a setback at 85 feet from the top of the bluff at its closest point, as shown on the site map prepared 8/20/06 amended 9/1/06 by Penny Lumber. ADDITIONAL INFORMATION: During the hearing, the applicants were asked, and they agreed, to plant vegetation (plantings) at the top of the bluff yard area. That additional plantings shall be placed and maintained for continuous vegetation near the top of the bluff. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The deck will be a one-story, uncovered structure, that is customary to a residence, and is similar to other homes in the immediate area. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The existing house has a current setback from the bluff at 101 feet. An addition of any size would require a variance, no matter how small. 3. The variance granted herein is not substantial. 4. The difficulty has been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Simon, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared by John C. Ehlers, Land surveyor dated 4/28/00 and site plan prepared 8/20/06 amended 9/1/06 by Penny Lumber, subject to the following condition: That the deck shall remain open to the sky. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. No 5960 (Kiefer) ...****....**....**..****....**.*****..****...****..****...***.....*.....**....... As requested, an evaluation of the site referenced above was conducled on October 13, 2006. The following observations were made. The rear yard of the property is sloped away from the bluff and completely vegetated with turf grasses; roofnmoffwater is collected in gutters and discharged into the ground through downspouts and drywel1s; the top of the bluff was measured to be 99 feet from the house; the bluff is relatively low with a steep face and is nearly vertical for the upper two feet; vegetation on the bluff face consists of annual weeds, Sparse clumps of American Beachgrass and several plantings of Rugosa Rose; there is a fair amount of American Beachgrass at the foot of the bluffand on the very rocky beach; soils of the bluff contain a lot of fine loam and clay with many rocks and boulders. Tn spite of the Sparse vegetative cover, the bluff appears stable and the addition of a deck at this site should not jeopardize the stability oftbe bluff. 423 GIUFFlNG A.
