SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 11,275 sq. ft. nonconforming parcel has 75 feet along
the east side of Marlene Lane and lot depth of 151.10 feet along the southerly side line. The property is
improved with a single-story, one-family dwelling, as shown on the September 17, 2002 survey updated
November 7, 2006 by Pat T. Seccafico.
BASIS OF APPLICATION: Request for a Variance under Section 280-122 (formerly 100-244B), based on the
Building Inspector's June 16, 2006 Notice of Disapproval concerning a proposed 16' by 20' accessory garage
which increases the lot coverage over the 20.89% permitted under Appeal No. 5298 (2003) and the 20% code
limitation.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 25, 2007, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
VARIANCE RELIEF REQUESTED: The applicants wish to construct an accessory 16' x 20' one-car, single-
story garage and seek an area variance concerning their proposed 24.2% lot coverage for construction of a
20' x 16' accessory garage at a maximum height of 18 feet measured from ground to the top of the ridge. The
garage is proposed in the rear yard at a minimum of four feet from the rear and side lot lines.
ADDITIONAL INFORMATION Appeal # 5298): On May 1, 2003 the Zoning Board of Appeals granted the
owner/applicant alternative relief of 20.89% lot coverage for an as-built sun room addition to their dwelling,
instead of the requested relief for lot coverage of 24% which included both the as built addition and a proposed
20' x 20' accessory garage. A condition from the Board of Appeals stipulated that there be no increased lot
coverage for addition(s) to the dwelling in the future. At the public hearing of April 17, 2003, the applicant
agreed to eliminate the proposed accessory garage from his application but stated that he would like to leave
the option open for a future application to locate a smaller structure (possibly a one car garage) on his
property.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or
a detriment to nearby properties. Most homes in the neighborhood have garages. The applicant's house has a
very large footprint on a long and narrow lot that would make an attached garage very difficult to site at this
time. The southeast corner of the rear yard of the subject property, the proposed location for an accessory
garage, is heavily screened by a wooded lot to the east and by a vegetative buffer of mature evergreens along
the southern side yard property line, and is setback at the farthest possible distance from Marlene Lane.
Therefore there will be negligible visual impact from the proposed accessory garage.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance for the relief requested because the property already exceeds the lot
coverage that is permitted by code.
3. The variance granted herein is substantial. The requested lot coverage of 24.2% represents an increase of
21 % beyond the 20% permitted by code. Although the previous decision by the ZBA conditioned no increase
in lot coverage for addition(s) to the dwelling, they did not place the same condition on accessory structures.
The applicant has reduced the size of his original proposed accessory garage from 20' x 20' (400 sq. ft.) to 20'
x 16' which will permit storage for one car and various yard and household items. The proposed accessory
garage is modest at 320 square feet.
4. The alleged difficulty has been self-created because the applicant could have included a garage in his
original plans when the home was newly designed.
5. No evidence has been submitted to suggest that the proposed garage will have an adverse impact on
physical or environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly
carried, to
GRANT the variance as applied for, shown on the survey prepared by survey prepared and updated
November 7, 2006 by Pat T. Seccafico, subject to the following condition:
That there be no increase in lot coverage for additions to the dwelling and/or accessory
structures or buildings.
That this ZBA condition be written into the Building Inspector's Certificate of Occupancy, when issued.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity. Any deviation from the variance given such as extensions, or
demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under
this application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the Zoning
Code, other than such uses, setbacks and other features as are expressly addressed in this action.

c. The work covered by this application may not be' commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Ihspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throu~hout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work aulhorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from ~uch date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
