I AM SURE YOU ARE FAMILIAR WITH MY ATTEMPTS TO CONSTRUCT A ONE
FAMILY DWELLING ON MY PROPERTY AT THE END OF EAST ROAD, FLEET'S
NECK, CUTCHOGUE, DESPITE THE FACT THAT SEVERAL APPROVALS TO
DEVELOP THE PROPERTY 'WERE GRANTED IN THE PAST, MY CONTINUING
ATTEMPTS TO UPDATE THOSE APPROVALS AND SECURE OTHERS NECESSARY TO
BUILD HAVE PROVEN DIFFICULT AND TIME CONSUMING TO OBTAIN. MOST
RECENTLY, I HAVE RECEIVED A DENIAL OF MY APPLICATION TO INSTALL A
SANITARY SYSTEM AND WELL FROM THE SUFFOLK COUNTY DEPARTMENT OF
HEALTH SERVICES. ALTHOUGH IT IS LIKELY THAT I WILL APPEAL THAT
DECISION THROUGH THE COURTS, I WISH TO ASCERTAIN WHETHER THE TOWN
HAS ANY INTEREST IN ACQUIRING THIS PROPERTY FOR PUBLIC USAGE OR
CONSERVATION PURPOSES. THE FLEET'S NECK ASSOCIATION HAS
CONSISTENTLY STATED THAT THE PROPERTY IS ENVIRONMENTALLY
SENSITIVE AND SHOULD BE PRESERVED FOR PUBLIC USE.
I DO NOT BELIEVE THAT THE TOWN OF SOUTHOLD WOULD DENY ALL USE AND

Pursuant to the SEQRA Scoping Session of the Zoning Board of
Appeals and Town Trustees in the matter of the application of
Gus Wade, the Town Trustee office recently agreed to thoroughly
search for preservation alternatives for the "island" which
included transfer or other method of town acquisition.
As a result of this process I have personally inventoried nearly
2,000 acres of Town Trustees land and other Town Lands which I
considered suitable for transfer.
One Such possibility was the "Orient by the Sea" subdivision
road end recently contemplated for sale by the Town Board.
Although there seems to be a general consensus within that
subdivision community that transfer or sale of the road end
would benefit the Town, Mr. Wade has declined to further discuss
this option. (see attached letter).
Unfortunately the only Trustee land available which would not
involve boundary disputes is the site of the currently proposed
boat launch ramp at Mattituck Creek.
As the Trustees have now exhausted all possibilities known to
them I want to take this opportunity to alert all Town
departments to the fact that Mr. Wade will consider transfer of
his "island" leading to his acquisition of a suitable similar
parcel. His "island" is approximately one half acre and affords
Mr. Wade the right of a conventional dock under his trustee
permit. I understand he is seeking a similar parcel on peconic
Bay or its tributaries which will permit him a house and dock
for his boat.
Absent the receipt of your departments comments in the Town
Trustees office by January 1, 1991 this office will consider our

obligation under the scoping session complete and shall
consider the presently suspended SEQRA time frames reactivated
as of that date. Thank you for your cooperation in this matter.

RESOLUTION - July 27, 1990
WHEREAS, GUSTAVE J. WADE has heretofore applied to the Southold
Town Board of Appeals for a 280-A (Access by Right-of-Way)
status by water by way of Eugenes Creek to Parcel, located in an
R-40 Zone District on certain property located at East Road,
Cutchogue, New YorK; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That pursuant to the provisions of Article 8 of the
Environmental Conservation; Law Part 617 of Title 6 of the New
York State Codes, Rules and Regulations, and Chapter 44 of the
Southold Town Code, the Southold Town Board of Appeals declares
shared Lead Agency with the Southold Town Trustees, does hereby
determine that the action proposed is Type 1 action and is
likely to have a significant effect on the envionment.
2. That the Board of Appeals shall file and circulate
such determination as required by the aforementioned law, rules
and code.
3. That the Board of Appeals immediately notify the
applicant, Gustave Wade, of this determination and inform the
applicant that a Scoping Session will be initiated by this Board
and all involved agencies. The purpose of this session is to
identify the relevant environmental issues, all in accordance
with said law, rules and code.

This is an appeal of a determination of the Building Inspector
whereby he purportedly revoked Building Permit No. 13244Z issued to
Appellant Wade for the construction of a dwelling on Appellant's land
adjacent to Eugene's Creek at Cutchogue, New York.

By Appeal No. 3295, this Board determined that Building Permit
No. 13244Z was improperly issued and declared the same void. Since
the permit was void from its inception, it should not be reinstated.
As stated in Appeal No. 3295, in which Appellant herein participated,
Appellant's remedy is by way of an appeal to this board pursuant to the
provisions of subdivision 3 of Section 280-a of the Town Law.
Accordingly, on motion by Mr. Grigonis, seconded by Mr. Goehringer,
IT WAS RESOLVED, that Appellant's remedy is by way of an appeal
to this board pursuant to the provisions of subdivision 3 of Section
280-a of the Town Law. . .
