DESCRIPTION OF ACTIVITY: Coastal Erosion Permit to repair the existing dock on
the seaward side of the concrete seawall; dock is 111 '-5" X 10' with an "L" section on
the northerly side of the seaward end 20'-4" X 10'. Repair 3' wide steps to grade with an
8' run on the north side of the dock near the landward end, a TX 10' ramp to grade on
the landward side of the seawall, and to repair approx. 20' of the concrete seawall,
inkind/inplace, on the northerly side of the dock, and all with the condition the off-shore
pile to the west of the dock is removed, and as depicted on the plan prepared by
Proper-T Permit Services dated
Permit to construct and complete project will expire two years from the date the permit
is signed.
SPECIAL CONDITIONS: (apply if marked)
_ Bluff restoration through a re-vegetation plan is a necessary special condition of this permit.
_ A relocation agreement is attached hereto and is a necessary special condition of this permit.
_ A maintenance agreement is attached with application and is a necessary special condition of

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Tues.,
November 9, 2004, the following recommendation was made:
EDGAR SMITH for the existing dock on the seaward side of the concrete seawall; dock
is 111 '-5" X 10' with an "L" section on the northerly side of the seaward end 20'-4" X 10'.
At the seaward end of the dock structures consisting of pilings and horizontal timbers
extend approx. 10' from the northerly side and approx. 20' from the southerly side.
There are 3' wide steps to grade with an 8' run on the north side of the dock near the
landward end. A three-pile dolphin is located off the northerly side of the dock and a TX
10' ramp to grade exists on the landward side of the seawall. The project also includes
the repair of approx. 20' of the concrete seawall, inkind/inplace, on the northerly side of
the dock.

The CAC notes that there are presently two docking facilities on the property. The
council recommends removal of one dock and repair of the remaining dock in
accordance with the Code.

Dear Mr. Fitzgerald:
Pursuant to IS CFR Part 930.58, the following data and information are necessary to enable the
Department of State to adequately assess the coastal zone effects of this proposed activity:
The proposed dock, as an accessory structure to the primary upland residential use of the property, is
not considered to be water-dependent. Such a structure may be built in order to exercise a riparian
landowner's right to access the water in a manner that is reasonable and necessary.
Please provide documentation of authorization for the existing bulkhead. From the submitted
information it appears therc is a Right-of-Way (KO.W.) that traverses the applicants parcel. Please
provide a metes and bounds description for the subject parcel. Information detailing the R.O.W. is
necessary. Additionally, information identifying the owner of the underwater lands is necessary.
A revised scaled site plan which illustrates thc adjacent in-water structures is necessary. Alternatives
as to the design, configuration, and location of the existing structure also needs to be provided.
Please provide the information requested above as soon as possible. If this necessary information and
data arc not provided within thirty days of the date of this letter, the Department of State may close the
file regarding this proposed activity. If the Department closes the file and does not concur with the
consistency certification provided for this proposed activity, the consistency provisions of the federal
Coastal Zone Management Act prohibit federal agency authorization of the proposal.

seawall; dock is 111'-5" x I 0' with an "L" section on the northerly side of the seaward end 20'-4" x lO'.
At the seaward end of the dock structures consisting of pilings and horizontal timbers extend approxi-
mately 10'from the northerly side and approximately 20' from the southerly side. There are 3'-wide steps
to grade with an 8' run on the north side of the dock near the landward end. A three-pile dolphin is located
off the northerly side of the dock and a 7' x 10' ramp to grade exists on the landward side of the seawall.
The project also includes the repair of approximately 20' of the concrete seawall, in-kind-in-place, on the
northerly side of the dock.
