1. I am the President of the Pimlico Group, and am personally familiar with the facts
stated herein. I make this affidavit to show the mailing of the Notice of Public
Hearing dated April 26, 2001, a copy of which is attached hereto.
2. On May 8, 2001, I obtained printed mailing labels from the Southold Town
Assessor's Office for each of the owners ofreal property within the Mattituck Park
District, as shown upon the latest completed and filed Special Assessment Roll of
the Town, consisting of 3,835 properties.
3. On May 9, 2001, I personally mailed at the United States Post Office in Mattituck,
New York, by prepaid first class mail addressed to each of said owners, as verified
from the official records on file with the Southold Town Assessors Office, a true
copy of the attached Legal Notice.

NOTICE OF PUBLIC HEARING
RE: MA TTITUCK PARK DISTRICT
IN THE TOWN OF SOUTHOLD, NY
WHEREAS, following receipt of a resolution and petition, each dated April 5,
200 I and in due form, from the Board of Commissioners of the Mattituck Park District, in the
Town of Southold (herein called the "District"), it has been determined by the Town Board of
the Town of South old, (herein called "Town Board" and "Town", respectively) Suffolk County,
New York, on the 26th day of April, 2001, to consider the increase and improvement of facilities
of the District consisting of the construction of a building at Veteran's Memorial Park, Peconic
Bay Boulevard, Mattituck, in the District, for use as storage and maintenance building for
equipment and two offices, for a concession stand and for bathroom facilities (herein called
"Project"), at the estimated maximum cost of $325,000, of which $45,000 has been heretofore
appropriated from the District's Operating Fund pursuant to resolution adopted by said Board of
Commissioners of the District and approved by the voters of the District at the referendum held
on July 20, 2000;
NOTICE IS HEREBY GIVEN that the Town Board will meet at the Town Hall,
53095 Main Road, Southold, New York, at 5:00 o'clock P.M. (Prevailing Time), on May 22,
2001, for the purpose of conducting a public hearing to consider the Project at the estimated
maximum cost of $325,000 and to provide for financing that portion of such cost not provided
from the District's Operating Fund by the issuance of obligations of the Town in the sum of
$280,000 pursuant to the Local Finance Law.
At said public hearing, the Town Board will hear all persons interested in the
subject matter thereof concerning the same.

The construction of a building at PUBLIC HEARlNG
Veteran's Memorial Park, in the TO BE HELD ON THE
Mattituck Park District. 22nd DAY OF MAY 2001.
WHEREAS, the Board of Commissioners of the Mattituck Park District (the "Board" and the
"Park District", respectively) of the Town of South old (the "Town"), Suffolk County, New York,
pursuant to the resolution adopted and subscribed by said Board of Commissioners on April 5, 2001
and together with the petition in due form, duly submitted to the Town Board (the "Town Board") of
the Town (certified copies of such resolution and petition are attached hereto and made a part hereof) ,
has requested the Town Board to call a public hearing to hear all persons interested in the subject

thereof, being the construction of a building at the existing Veteran's Memorial Park, Peconic Bay
Boulevard, Mattituck, in the Park District, for use as a storage and maintenance building for equipment
and two offices, for a concession stand and for bathroom facilities (herein called the "Project") , the
estimated maximum cost thereof being $325,000, of which $45,000 will be provided from moneys
now available in the District's Operating Fund, and to finance the balance of such cost ($280,000) by
the issuance of obligations of the Town pursuant to the Local Finance Law; and that to pay the
principal of and interest on such obligations as the same shall become due and payable, a sum
sufficient therefor shall be levied and collected from the several lots and parcels ofland within the
District, in the same manner and at the same time as other Town charges; and.
WHEREAS, said Board of Commissioners, in the role of Lead Agency, has undertaken the
requisite proceedings pursuant to the New York State Environmental Quality Review Act ("SEQRA")
and has determined that the Project is an Unlisted Action thereunder having no adverse impact upon
the environment. NOW THEREFORE, IT IS
ORDERED, that a public hearing be held by the Town Board on the 22nd day of May, 2001,
at 5:00 o'clock P.M. (Prevailing Time), at the Southold Town Hall, 53095 Main Road, Southold, in
the Town, to consider the Project, and to finance that portion of the cost thereof not provided from the
District's Operating Fund by the issuance of Town obligations pursuant to the Local Finance Law as
hereinafter referred to and the levy and collection upon the several lots and parcels ofland within the
Park District, of a sum sufficient to pay the principal of and interest on such obligations as the same
shall become due and payable, in the same manner and at the same time as other Town charges; and
ALL PERSONS desiring to be heard concerning the subject matter of the above referenced
public hearing will be given an opportunity to be heard at the time and place aforesaid;
AND, IT IS
FURTHER ORDERED that the Town Clerk is hereby authorized and directed to cause a copy
ofthis Order to be published once in "THE SUFFOLK TIMES", a newspaper published in Mattituck,
having a general circulation within the Town of Southold, and, further, to cause to be posted a copy of
this order on the sign board of the Town and in five conspicuous public places within the District, and,
further, to cause to be mailed by first class mail to each owner of real property in the District subject to
the assessment, levy and collection of amounts equal to the principal of and interest on such
obligations when due and payable, such publication, such posting and such mailing to occur not less
than ten (10) nor more than twenty (20) days prior to such public hearing. By Order ofthe Southold

We have an affidavit that was posted on the Town Clerk's Bulletin Board, and published in the
newspaper, the local paper. That is the reading.
SUPERVISOR COCHRAN: You have heard the reading of a public hearing on bonding from the
Mattituck Park District to construct on the Veteran's Memorial Park a building. At this time, i there is
anyone that would like to speak either pro or con in relation?
GAIL WICKHAM: Good evening. My name is Gail Wickham, and I am counsel for the Mattituck
Park District. First of all, I would like to just clarify that the total appropriation is $325,000, but the
bond request is for $280,000. The difference coming from funds of the District currently in hand. So, if
we could correct the record as that. It is a little confusing, and also I would just like to mention to the
Board that this project, the construction, the funding, the appropriation, and the request for bonding
was approved by the voters of the Park District at a public referendum. Thank you.

SUPERVISOR COCHRAN: Anyone else like to address the Board?
GERTRUDE COUPE: I am Gertrude Coupe of Mattituck. Several weeks ago I read an article in the
paper concerning the children's playground being developed in the Veteran's Park, and that the
Southold Town Board had approved paying a small portion ofthat amount. There was a comment that
therefore the Board felt that the Park should be open to all children. I would like to ask if the same
thought carries over to this bonding of the building at the Veteran's Park. What strings are attaching to
your support?
SUPERVISOR COCHRAN: We have not attached any strings to any of our support, be it for a
playground or this building. We were approached by a group of young mothers, that are raising the
funds or helping to raise the funds for the park district to put the playground in place, and they offered
the fact that other small children within the community would be able to use this playground. It had no
strings attached, and we felt we would like to support this. Anytime when we can get a playground in
the Town of Southold for our young people we try to do. Community Development Funds we use. This
is what they wanted to do. We had a bunch of moms that raised $20,000 to put a playground on
Peconic Lane at our park, and we would like to see partnerships like this developed in the community,
not only the young moms do it for playground, but also in the park district. We have another
partnership with them, volley ball courts up on the beach, so we try to work together where we can.
JUSTICE EVANS: The hearing now is on the Park District bonding. It is the Park District that will be
bonding for the money.
SUPERVISOR COCHRAN: We are the vehicle that has to do the bonding for the park district.
Anyone else like to address the Town Board? Yes, sir?
HANK KUHN: Good evening. Hank Kuhn from Laurel. Just a few questions. Perhaps I missed some
of the previous information that was given out. If you could give us an estimate of the square footage
of the building? Three things if I could run through them real quickly. The Notice of Public Hearing
uses the estimated maximum.
SUPERVISOR COCHRAN: Perhaps Mr. Goehringer or Gail would like to answer these question.
HANK KUHN: I just wondered if the maximum for the bond issue, or the combination of the bond
and funds is $325,000, why did you use the word estimated in the notice?
GAIL WICKHAM: Let me see if I can answer what I think are his two questions so far. The size of
the building is sixty feet by eighty feet, and the word estimated was put in because that is an estimate,
but the maximum cannot exceed $325,000. It may be less, and therefore since it hasn't gone out to bid
yet we cannot specify the exact. It will not exceed including all costs.
HANK KUHN: The last question is taxes. What will be the effect ofthe taxes?
SUPERVISOR COCHRAN: That is Park District taxes.
GAIL WICKHAM: That will depend on the budget that is passed following this.

HANK KUHN: Well, if you go out for $280,000 for a bond you have got to pay a certain interest rate,
and that is going to affect. How much is that?
GAIL WICKHAM: That will have to be bid as well, and determined and factored into the budget.
HANK KUHN: No estimates on it?
GAIL WICKHAM: I don't have them.
GERALD GOEHRINGER: Gerald Goehringer, Senior Commissioner. This will be bonded over a
period of fifteen years. Okay? So, very simply it would probably have a negligible effect on the budget
itself. Our normal increases range between about 3.55% and about 4% a year. If it had a I % effect I
would say that would be a great amount on the budget, and as I say we are bonding for a IS-year
period. We would be very happy to give that information before the next budget vote.
HANK KUHN: It should be made available, sir.
GERALD GOEHRINGER: No problem.
SUPERVISOR COCHRAN: Anyone else to ask questions in relation to the bonding for a building

WHEREAS, following the receipt of a certified copy ofthe Resolution adopted by the
Board of Commissioners of the Mattituck Park District, in the Town of South old (hereinafter
called "District" and "Town," respectively), in the County of Suffolk, New York and the Petition
of said Board of Commissioners, each duly subscribed by the Commissioners of the District,
requesting that the Town Board of the Town (herein called the "Town Board"), call a public
hearing to consider the increase and improve the facilities ofthe District as hereinafter described
at the estimated maximum cost of $325,000 and to finance, by the issuance of obligations
pursuant to the Local Finance Law, that portion of said cost not provided by the appropriation of

RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE
COUNTY OF SUFFOLK, NEW YORK by the favorable vote of not less than two-thirds of all

Section 1. The Town hereby authorizes the expenditure of$325,000, including the
amount of$45,000 heretofore appropriated from the Operating Fund of the District as
hereinabove referred to, to pay the cost ofthe increase and improvement of the District,
described as the construction of a building at Veteran's Memorial Park, Peconic Bay Boulevard,
Mattituck, in the District, for use as a storage and maintenance building for equipment for two
offices, for a concession stand and for bathroom facilities (herein called the "Project") and
hereby appropriates and authorizes the expenditure of the amount of $280,000 therefor to be
financed by the issuance of obligations of the Town as herein after provided, construction ofthe
Project having been heretofore authorized pursuant to the Resolution and Order After Public
Hearing referred to in the Recital hereof. The estimated maximum cost of said specific object or
purpose, including preliminary costs and costs incidental thereto and to the financing thereof, is
$325,000. The plan of financing includes the expenditure of the amounts of $45,000 from the
District's Operating Fund and $280,000 herein appropriated and authorized to be expended and
the issuance of$280,000 serial bonds of the Town to finance said $280,000 appropriation and
such, amount, including payment of principal and interest on such obligations, shall be assessed,
levied and collected from the several lots and parcels of land within the District by the Town
Board in the manner provided by law, but ifnot paid from such source, all the taxable property
within the Town shall be subject to the levy of an ad valorem tax, without limitation as to rate or

amount sufficient to pay the principal of and interest on said obligations as the same shall
become due and payable.
Section 2. Serial bonds of the Town are hereby authorized to be issued in the principal
amount of$280.000 pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called "Law"), to finance said
appropriation of $280,000.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness of the Project, being the specific object,
or purpose for which said $280,000 serial bonds are authorized to be issued within the limitations
of Section 11.00 a. I 1. (c) of the Law is fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of Said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
Section 4. Each of the bonds authorized by this resolution and any bond anticipation
notes issued in anticipation of aid bonds shall contain the recital of validity prescribed by Section
52.00 of the Law and sad bonds, and any notes issued in anticipation said, bonds, shall be
general obligations of the Town, payable as to both principal and interest by a general tax upon
all the taxable real property within the Town without limitation as to rate or amount. The faith
and credit of the Town are hereby irrevocably pledged to the punctual payment ofthe principal
of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes issued in anticipation thereof to
mature in such year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the
provisions of Section 21.00 relative to the authorization of the issuance of bonds having
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance ofbond anticipation notes, and Section 50.00 and Sections 56.00 to 60.00 ofthe
Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes
and prescribing their terms, form and contents and as to the sale and issuance of the bonds herein

authorized, and any other bonds heretofore or hereafter authorized, and of any bond anticipation
notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any notes
issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the Town is not
authorized to expend money, or
(b) the provisions oflaw which should be complied with at the date of the publication of
such resolution, or a summary thereof, are not substantially complied with,
and an action, suit or proceeding contesting substantially validity, is commenced within twenty
days after the date of such publication, or

will be provided from moneys heretofore appropriated by the qualified voters of the District at

Now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN
THE COUNTY OF SUFFOLK, NEW YORK (by the favorable vote of not less than two-thirds
of all the members of said Board) AS FOLLOWS:
Section 1. The Town hereby authorizes the expenditure of$325,000, including the
amount of $45,000 heretofore appropriated from the Operating Fund of the District as
hereinabove referred to, to pay the cost of the increase and improvement of the District, described
as the construction of a building at Veteran's Memorial Park, Peconic Bay Boulevard, Mattituck,
in the District, for use as a storage and maintenance building for equipment for two offices, for
a concession stand and for bathroom facilities (herein called the "Project") and hereby
appropriates and authorizes the expenditure of the amount of $280,000 therefor to be financed by
the issuance of obligations of the Town as hereinafter provided, construction of the Project having

been heretofore authorized pursuant to the Resolution and Order After Public Hearing referred
to in the Recital hereof. The estimated maximum cost of said specific object or purpose,
including preliminary costs and costs incidental thereto and to the financing thereof, is $325,000.
The plan of financing includes the expenditure of the amounts of $45,000 from the District's
Operarting Fund and $280,000 herein appropriated and authorized to be expended and the
issuance of $280,000 serial bonds of the Town to finance said $280,000 appropriation and such
amount, including payment of principal and interest on such obligations, shall be assessed, levied
and collected from the several lots and parcels of land within the District by the Town Board in
the manner provided by law, but if not paid from such source, all the taxable property within the
Town shall be subject to the levy of an ad valorem tax, without limitation as to rate or amount,
sufficient to pay the principal of and interest on said obligations as the same shall become due and
payable.
Section 2. Serial bonds of the Town are hereby authorized to be issued in the
principal amount of $280,000 pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law"), to
finance said appropriation of $280,000.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness of the Project, being the specific object
or purpose for which said $280,000 serial bonds are authorized to be issued, within the limitations
of Section 11.00 a. II.(c) of the Law, is fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made

after the effective date of this resolution for the purpose for which said bonds are authorized. The
foregoing statement of intent with respect to reimbursement is made in conformity with Treasury
Regulation Section 1.150-2 of the United States Treasury Department.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of said bonds shall contain the recital of validity
prescribed by Section 52.00 of the Law and said bonds, and any notes issued in anticipation said
bonds, shall be general obligations of the Town, payable as to both principal and interest by a
general tax upon all the taxable real property within the Town without limitation as to rate or
amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment
of the principal of and interest on said bonds and any notes issued in anticipation of the sale of
said bonds and provision shall be made annually in the budget of the Town by appropriation for
(a) the amortization and redemption of the bonds and any notes issued in anticipation thereof to
mature in such year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and pursuant
to the provisions of Section 21.00 relative to the authorization of the issuance of bonds having
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes, and Section 50.00 and Sections 56.00 to 60.00 of the
Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and
prescribing their terms, form and contents and as to the sale and issuance of the bonds herein
authorized, and any other bonds heretofore or hereafter authorized, and of any bond anticipation
notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.

Section 6. The validity of the bonds authorized by this resolution, and of any notes
issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the Town
is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially complied with,
and an action, suit or proceeding contesting such validity, is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized III violation of the provIsIOns of the
constitution.
Section 7. This resolution shall take effect immediately.

estimated maximum cost thereof being $325,000, of which $45,000 will be provided from moneys
now available in the District's Operating Fund, and to finance the balance of such cost ($280,000) by
the issuance of obligations of the Town pursuant to the Local Finance Law; and that to pay the
principal of and interest on such obligations as the same shall become due and payable, a sum
sufficient therefor shall be levied and collected from the several lots and parcels ofland within the
District, in the same manner and at the same time as other Town charges; and.
WHEREAS, said Board of Commissioners, in the role of Lead Agency, has undertaken the
requisite proceedings pursuant to the New York State Environmental Quality Review Act ("SEQRA")
and has determined that the Project is an Unlisted Action thereunder having no adverse impact upon
the environment. NOW THEREFORE, IT IS
ORDERED, that a public hearing be held by the Town Board on the 22nd day of May, 2001,
at 5:00 o'clock P.M. (Prevailing Time), at the Southold Town Hall, 53095 Main Road, Southold, in
the Town, to consider the Project, and to finance that portion of the cost thereof not provided from the
District's Operating Fund by the issuance of Town obligations pursuant to the Local Finance Law as
hereinafter referred to and the levy and collection upon the several lots and parcels ofland within the
Park District, of a sum sufficient to pay the principal of and interest on such obligations as the same
shall become due and payable, in the same manner and at the same time as other Town charges; and
ALL PERSONS desiring to be heard concerning the subject matter of the above referenced

this order on the sign board ofthe Town and in five conspicuous public places within the District, and,
further, to cause to be mailed by first class mail to each owner ofreal property in the District subject to
the assessment, levy and collection of amounts equal to the principal of and interest on such
obligations when due and payable, such publication, such posting and such mailing to occur not less

We have an affidavit that was posted on the Town Clerk's Bulletin Board, and published in the
newspaper, the local paper. That is the reading.
SUPERVISOR COCHRAN: You have heard the reading of a public hearing on bonding from the
Mattituck Park District to construct on the Veteran's Memorial Park a building. At this time, i there is
anyone that would like to speak either pro or con in relation?
GAIL WICKHAM: Good evening. My name is Gail Wickham, and I am counsel for the Mattituck
Park District. First of all, I would like to just clarify that the total appropriation is $325,000, but the
bond request is for $280,000. The difference coming from funds of the District currently in hand. So, if
we could correct the record as that. It is a little confusing, and also I would just like to mention to the
Board that this project, the construction, the funding, the appropriation, and the request for bonding
was approved by the voters of the Park District at a public referendum. Thank you.

SUPERVISOR COCHRAN: Anyone else like to address the Board?
GERTRUDE COUPE: I am Gertrude Coupe of Mattituck. Several weeks ago I read an article in the
paper concerning the children's playground being developed in the Veteran's Park, and that the
Southold Town Board had approved paying a small portion of that amount. There was a comment that
therefore the Board felt that the Park should be open to all children. I would like to ask if the same
thought carries over to this bonding of the building at the Veteran's Park. What strings are attaching to
your support?
SUPERVISOR COCHRAN: We have not attached any strings to any of our support, be it for a
playground or this building. We were approached by a group of young mothers, that are raising the
funds or helping to raise the funds for the park district to put the playground in place, and they offered
the fact that other small children within the community would be able to use this playground. It had no
strings attached, and we felt we would like to support this. Anytime when we can get a playground in
the Town of Southold for our young people we try to do. Community Development Funds we use. This
is what they wanted to do. We had a bunch of moms that raised $20,000 to put a playground on
Peconic Lane at our park, and we would like to see partnerships like this developed in the community,
not only the young moms do it for playground, but also in the park district. We have another
partnership with them, volley ball courts up on the beach, so we try to work together where we can.
ruSTlCE EVANS: The hearing now is on the Park District bonding. It is the Park District that will be
bonding for the money.
SUPERVISOR COCHRAN: We are the vehicle that has to do the bonding for the park district.
Anyone else like to address the Town Board? Yes, sir?
HANK KUHN: Good evening. Hank Kuhn from Laurel. Just a few questions. Perhaps I missed some
of the previous information that was given out. If you could give us an estimate of the square footage
of the building? Three things if I could run through them real quickly. The Notice of Public Hearing
uses the estimated maximum.
SUPERVISOR COCHRAN: Perhaps Mr. Goehringer or Gail would like to answer these question.
HANK KUHN: I just wondered if the maximum for the bond issue, or the combination of the bond
and funds is $325,000, why did you use the word estimated in the notice?
GAIL WICKHAM: Let me see if I can answer what I think are his two questions so far. The size of
the building is sixty feet by eighty feet, and the word estimated was put in because that is an estimate,
but the maximum cannot exceed $325,000. It may be less, and therefore since it hasn't gone out to bid
yet we cannot specifY the exact. It will not exceed including all costs.
HANK KUHN: The last question is taxes. What will be the effect of the taxes?
SUPERVISOR COCHRAN: That is Park District taxes.
GAIL WICKHAM: That will depend on the budget that is passed following this.

HANK KUHN: Well, if you go out for $280,000 for a bond you have got to pay a certain interest rate,
and that is going to affect. How much is that?
GAIL WICKHAM: That will have to be bid as well, and determined and factored into the budget.
HANK KUHN: No estimates on it?
GAIL WICKHAM: I don't have them.
GERALD GOEHRINGER: Gerald Goehringer, Senior Commissioner. This will be bonded over a
period of fifteen years. Okay? So, very simply it would probably have a negligible effect on the budget
itself. Our normal increases range between about 3.55% and about 4% a year. If it had a I % effect I
would say that would be a great amount on the budget, and as I say we are bonding for a IS-year
period. We would be very happy to give that information before the next budget vote.
HANK KUHN: It should be made available, sir.
GERALD GOEHRINGER: No problem.
SUPERVISOR COCHRAN: Anyone else to ask questions in relation to the bonding for a building
being erected on the Mattituck Park District property? (No response.) If not, I will close the hearing.

The construction of a building at PUBLIC HEARING
Veteran's Memorial Park, in the TO BE HELD ON THE
Mattituck Park District. 220d DAY OF MAY 2001.
WHEREAS, the Board of Commissioners of the Mattituck Park District (the "Board" and the "Park
District", respectively) of the Town of Southold (the "Town"), Suffolk County, New York, pursuant to the
resolution adopted and subscribed by said Board of Commissioners on April 5, 2001 and together with the
petition in due form, duly submitted to the Town Board (the "Town Board") of the Town (certified copies of
such resolution and petition are attached hereto and made a part hereof) , has requested the Town Board to call a
public hearing to hear all persons interested in the subject thereof, being the construction of a building at the
existing Veteran's Memorial Park:, Peconic Bay Boulevard, Mattituck, in the Park District, for use as a storage
and maintenance building for equipment and two offices, for a concession stand and for bathroom facilities
(herein called the "Project"), the estimated maximum cost thereof being $325,000, of which $45,000 will be
provided from moneys now available in the District's Operating Fund, and to finance the balance of such cost
($280,000) by the issuance of obligations of the Town pursuant to the Local Finance Law; and that to pay the
principal of and interest on such obligations as the same shall become due and payable, a sum sufficient therefor
shall be levied and collected from the several lots and parcels of land within the District, in the same manner
and at the same time as other Town charges; and.
WHEREAS, said Board of Commissioners, in the role of Lead Agency, has undertaken the requisite
proceedings pursuant to the New York State Environmental Quality Review Act ("SEQRA") and has
determined that the Project is an Unlisted Action thereunder having no adverse impact upon the environment.
NOW THEREFORE, IT IS
ORDERED, that a public hearing be held by the Town Board on the 22nd day of May, 2001, at 5:00
o'clock P.M. (Prevailing Time), at the Southold Town Hall, 53095 Main Road, Southold, in the Town, to
consider the Project, and to finance that portion of the cost thereof not provided from the District's Operating
Fund by the issuance of Town obligations pursuant to the Local Finance Law as hereinafter referred to and the
levy and collection upon the several lots and parcels of land within the Park District, of a sum sufficient to pay
the principal of and interest on such obligations as the same shall become due and payable, in the same manner
and at the same time as other Town charges; and
ALL PERSONS desiring to be heard concerning the subject matter of the above referenced public
hearing will be given an opportunity to be heard at the time and place aforesaid;
AND, IT IS
FURTHER ORDERED that the Town Clerk is hereby authorized and directed to cause a copy of this
Order to be published once in "THE SUFFOLK TIMES", a newspaper published in Mattituck, having a general
circulation within the Town of Southold, and, further, to cause to be posted a copy of this order on the sign
board of the Town and in five conspicuous public places within the District, and, further, to cause to be mailed
by first class mail to each owner of real property in the District subject to the assessment, levy and collection of
amounts equal to the principal of and interest on such obligations when due and payable, such publication, such
posting and such mailing to occur not less than ten (10) nor more than twenty (20) days prior to such public
hearing.

WHEREAS Fredrick Lee & Karen A. Lee have made application pursuant to Chapter 6 of the Southold
Town Code for a refund of Community Preservation Funds paid; and
WHEREAS the Town Board believes it was not the intent of the Community Preservation Fund to
impose a 2% transfer tax on the sale of "preserved land"; and
WHEREAS Fred & Karen Lee paid $860.00 dollars pursuant to the 2% Community Preservation Fund
on land on which the development rights had been previously sold to the County of Suffolk; and
WHEREAS the Town Board has directed the Town Attorney's department and the Land Preservation
Department to prepare any necessary changes in the local law to make sure "preserved parcels" are not taxed
under the 2% CPF tax; be it

necessary parties are hereby directed, pursuant to the provision of Chapter 6 of the Southold Town Code to

WHEREAS the Town Board of the Town of South old as the governing body of the Southold Solid Waste
Management District held a public hearing on March 13, 2001 pursuant to Article 2 of the Eminent Domain
Procedure Law, regarding the acquisition of temporary easements over portions of certain parcels of property
located within the Town of Southold, in connection with the District's capping and closure of the Southold
Landfill located in Cutchogue, New York.
WHEREAS, the owner(s) of the following premises to be acquired and the District have reached an agreement
with respect to the District's acquisition of the temporary easement over the premises listed below; and
WHEREAS, it is in the mutual interest of the parties to enter into temporary easement agreements without the
need to proceed with the eminent domain proceeding; and
WHEREAS, the price per month agreed to with respect to the temporary easements specified in the
agreement(s) are within the range of market value for such use of the parcel(s); and
WHEREAS, in light of the costs attendant to proceeding with the eminent domain proceeding and the
uncertainties of litigation it is in the best interests of the District to enter into the temporary easement
agreements at this juncture; and
WHEREAS, the acquisition of these temporary easements are a necessary part of the closure of the Southold
Landfill and, as such, constitute a Type II action under the State Environmental Quality Review Act and 6
NYCRR 617.5( c) (29) since undertaken pursuant to the Stipulation of Settlement dated October 5, 1995
between the Town of Southold and the New York State Department of Environmental Conservation.
NOW BE IT RESOLVED, that the Town Board, as the governing body of the Southold Solid Waste

qualified voters of the District present and voting on a Proposition therefor at the Referendum
held in the District on July 20, 2000 and to hear all persons interested in the subject matter
thereof; and
WHEREAS, said Board of Commissioners, in the role of Lead Agency, has
undertaken the requisite proceedings pursuant to the New York State Environmental Quality
Review Act ("SEQRA") and has determined that the Project is an Unlisted Action thereunder
having no adverse impact upon the environment; and
WHEREAS, pursuant to the Order Calling Public Hearing, adopted April 26,
2001, a public hearing was duly held by the Town Board on this 22"d day of May, 2001, at 5:00
o'clock P.M. (Prevailing Time), at the Town Hall, 53095 Main Road, Southold, New York, in
the Town, and considerable discussion on the matter has been had and all persons desiring to be
heard have been heard, including those in favor of and those in opposition to the Project and the
financing thereof;
NOW, THEREFORE, on the basis of the information given at such hearing, it is
hereby
DETERMINED, that it is in the public interest to increase and improve the
facilities of the District as hereinabove described and referred to as the Project at the estimated

Finance Law, that portion of such cost not provided by the appropriation of $45,000 from the
District's Operating Fund; and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved
and financed as hereinabove described and, further, that the Engineer heretofore retained by the
Board of Commissioners shall prepare specifications and make careful estimates of the expense
of said increase and improvement of the facilities and with the assistance of the Attorney for the
District, prepare a proposed contract or contracts therefor, which specifications, estimate and
proposed contract(s) shall be presented to said Board of Commissioners as soon as possible; and
it is hereby
FURTHER ORDERED, that the expense of so increasing and improving such
facilities shall be financed as hereinabove set forth, and the costs thereof, including payment of
principal of and interest on said obligations, shall be assessed, levied and collected by the Town
Board from the several lots and parcels of land within the District in the manner provided by law,
but if not paid from such source, all the taxable property within said Town shall be subject to the
levy of an ad valorem tax, without limitation as to rate or amount, sufficient to pay the principal

ADOPTED MAY 22, 2001, APPROPRIATING THE AMOUNT OF
$280,000 IN ADDITION TO THE AMOUNT OF $45,000
HERETOFORE APPROPRIATED BY THE MATTITUCK PARK
DISTRICT, IN SAID TOWN, FOR THE INCREASE AND
IMPROVEMENT OF THE FACILITIES OF SAID PARK DISTRICT
AND AUTHORIZING THE ISSUANCE OF $280,000 SERIAL BONDS
OF SAID TOWN TO FINANCE SAID $280,000 APPROPRIATION.
Recital
WHEREAS, following the receipt of a certified copy of the Resolution adopted by
the Board of Commissioners of the Mattituck Park District, in the Town of Southold (hereinafter
called "District" and "Town," respectively), in the County of Suffolk, New York and the Petition
of said Board of Commissioners, each duly subscribed by the Commissioners of the District,
requesting that the Town Board of the Town (herein called the "Town Board"), call a public
hearing to consider the increase and improve the facilities of the District as hereinafter described
at the estimated maximum cost of $325 ,000 and to finance, by the issuance of obligations pursuant
to the Local Finance Law, that portion of said cost not provided by the appropriation of $45,000
from the District's Operating Fund, heretofore authorized by the qualified voters of the District
present and voting on a Proposition therefor at the Referendum held in the District on July 20,
2000, and to hear all persons interested in the subject matter thereof, and, following such public
hearing duly called and held, the Town Board has determined, pursuant to the Resolution and

Order After Public Hearing duly adopted on this date, that it is in the public interest to so increase
and improve the facilities of the District and has ordered that the facilities be so increased and
improved, at the estimated maximum cost of $325,000 and that the Engineer prepare
specifications and an estimate of the cost and, with the Attorney for the District, prepare a
proposed contract or contracts therefor to be presented to the said Board of Commissioner as soon
as possible; and
WHEREAS, the Board of Commissioners of the District, in the role of Lead Agency, has
determined and found that pursuant to the applicable provisions of the State Environmental
Quality Review Act ("SEQRA"), the Project is an Unlisted Action thereunder having no adverse
impact upon the environment;
Now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN
THE COUNTY OF SUFFOLK, NEW YORK (by the favorable vote of not less than two-thirds
of all the members of said Board) AS FOLLOWS:
Section 1. The Town hereby authorizes the expenditure of$325,000, including the
amount of $45,000 heretofore appropriated from the Operating Fund of the District as
hereinabove referred to, to pay the cost of the increase and improvement of the District, described
as the construction ofa building at Veteran's Memorial Park, Peconic Bay Boulevard, Mattituck,
in the District, for use as a storage and maintenance building for equipment for two offices, for
a concession stand and for bathroom facilities (herein called the "Project") and hereby
appropriates and authorizes the expenditure of the amount of $280,000 therefor to be financed by
the issuance of obligations of the Town as hereinafter provided, construction of the Project having

been heretofore authorized pursuant to the Resolution and Order After Public Hearing referred
to in the Recital hereof. The estimated maximum cost of said specific object or purpose,
including preliminary costs and costs incidental thereto and to the financing thereof, is $325,000.
The plan of financing includes the expenditure of the amounts of $45,000 from the District's
Operarting Fund and $280,000 herein appropriated and authorized to be expended and the
issuance of $280,000 serial bonds of the Town to finance said $280,000 appropriation and such
amount, including payment of principal and interest on such obligations, shall be assessed, levied
and collected from the several lots and parcels of land within the District by the Town Board in
the manner provided by law, but if not paid from such source, all the taxable property within the
Town shall be subject to the levy of an ad valorem tax, without limitation as to rate or amount,
sufficient to pay the principal of and interest on said obligations as the same shall become due and
payable.
Section 2. Serial bonds of the Town are hereby authorized to be issued in the
principal amount of $280,000 pursuant to the provisions of the Local Finance Law, constituting
Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law"), to
finance said appropriation of $280,000.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness of the Project, being the specific object
or purpose for which said $280,000 serial bonds are authorized to be issued, within the limitations
of Section 11.00 a. 1 1. (c) of the Law, is fifteen (15) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made

after the effective date of this resolution for the purpose for which said bonds are authorized. The
foregoing statement of intent with respect to reimbursement is made in conformity with Treasury
Regulation Section 1.150-2 of the United States Treasury Department.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of said bonds shall contain the recital of validity
prescribed by Section 52.00 of the Law and said bonds, and any notes issued in anticipation said
bonds, shall be general obligations of the Town, payable as to both principal and interest by a
general tax upon all the taxable real property within the Town without limitation as to rate or
amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment
of the principal of and interest on said bonds and any notes issued in anticipation of the sale of
said bonds and provision shall be made annually in the budget of the Town by appropriation for
(a) the amortization and redemption of the bonds and any notes issued in anticipation thereof to
mature in such year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and pursuant
to the provisions of Section 21.00 relative to the authorization of the issuance of bonds having
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes, and Section 50.00 and Sections 56.00 to 60.00 of the
Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and
prescribing their terms, form and contents and as to the sale and issuance of the bonds herein
authorized, and any other bonds heretofore or hereafter authorized, and of any bond anticipation
notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.

Section 6. The validity of the bonds authorized by this resolution, and of any notes
issued in anticipation of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the Town
is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially complied with,
and an action, suit or proceeding contesting such validity, is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This resolution shall take effect immediately.

places within the District, and, further, to cause to be mailed by first class mail to each owner of
real property in the District subject to the assessment, levy and collection of amounts equal to the
principal of and interest on such obligations when due and payable, such publication, such
posting and such mailing to occur not less than ten (10) nor more than twenty (20) days prior to
such public hearing.
