A. DescriDtion of the Site
The parcel offered to the Town of Southold is 12.9 acres total. The subject owner's total
acreage is 21.7 acres and includes woodland on Laurel Lake. The subject owner would retain the
woodland acreage. The 12.9 acres is located on the northside of Route 25, approximately 1,400
feet e/o of Aldrich Lane, -Laurel, New York, 11948. The offering parcel is level farmland and is
irregular in shape. The parcel is unimproved.
The subject parcel has development rights intact. The subject parcel is considered subdividable
subject to the Town of Southold application process.
The soil is mostly HaA or haven loam with a 0-2% slope. The hazard of erosion is slight and this
soil is commonly used for the growing of crops and housing developments.
The subject is not in a flood zone. The area is mostly farmlands with residential subdivisions
nearby. The nearest shopping district is Mattituck Village about I mile east.
The public utilities are electric and telephone. There are private water wells and private
cesspools.
Rout<..25 is a macadam road publlicly maintained. There are sidewalks, street lights and curbing.

Re: Acquisition of Development Rights from Cecil & Marian Young
Tax Map No. 1000-125-1-6.1
Dear Mr Lundstedt:
I have reviewed your proposal that Mr Young retain a 25 foot wide easement to
the wooded parcel in the back of his property with the Land Preservatlol').
Committee. While the committee believes it IS appropriate for Mr Youn,9 to
retain access to that property. the proposed location of that access dc/,vn the
center of the farm parcel is not acceptable. for the following reasons:
. an accessway down the center of the farm parcel will make it more
difficult to farm the parcel.
. the proposed location of the road will consume nearly one-half acre of
farmland. reducing the price which will be paid by the Town to Mr
Young.
. the length of the proposed accessway will make it very expensive to
develop and maintain.
The Town proposes that the accessway be located on the east side of the
property Such location would marginally affect the farmland, have a mirllmal
impact on the price of development rights being purchased, keep the road away
from the Young residence and minimize the length of the accessway.

The land Preservation Committee has unanimously recommended we
purchase the development rights of these two parcels. We think they will
be very worthwhile additions to the portfolio of properties, that the Town
has already preserved. The Young property is on the Main Road in
Matti tuck, just west of the Town park, and the property abuts land on
Laurel lake, so therefore the property will help protect laurel Lake in
any encroaching development. The other property, the Catz/McDowell
farm is on Oregon :Road, and that, of course, is the pristine farming area
in t;his (;ommuni~y~ and we are striving to purchase development rights in

comprising approximately 30 acres, at a sale price of $180,000; said property located
at 86110 Oregon Road, Cutchogue, N.Y., Suffolk County Tax Map No. 1000-95-11-
111.1; and the aforesaid agricultural lands of Cecil & Marion Young, comprising
approximately 12.9 acres, at a sale price of $1011,000; said property located at Route
25, Laurel, N.Y.., Suffolk County Tax' Map No. 1000-125-1-6.1; and be it
FURTHER RESOLVED that the Town Clerk be and .she hereby is authorized and'
directed to give notice of such acceptance to (1) Walter Gatz & George McDowell,

THIS INDENTURE, made the 8th day of October, 1997
BETWEEN CECIL 1. YOUNG AND MARIAN G. YOUNG, HIS WIFE AS
TENANTS IN COMMON EACH TENANT HAVING AN UNDIVIDED ONE HALF
INTEREST, residing at No. # Main Road, Laurel, New York 11948, party of
the first part,

THE TOWN OF SOUTHOLD, a municipal corporation of the state of
New York, having its office qhd principal place of business at 53095 Main
Road, Town of Southold, County of Suffolk and State of New York, party of
the second part,
WITNESSETH
That the party of the first part, in consideration of ten :$10.00) dollars,
lawful money of the United States, and other good and valuable
consideration paid by the party of the second part,
DOES HEREBY GRANT AND RELEASE unto the party of the second
part, its successors and assigns forever, the DEVELOPMENT RIGHTS, by
which is meant the permanent legal interest and right, as authorized by
Section 247 of the New York state General Municipal Law, as amended,

to permit, require or restrict the use of the premises exclusively for
agricultural production as that term is presently defined in Chapter 25 of
the Code of th.e Town of Southold, and the right to prohibit or restrict the
use of the premises for any purpose other than agricultural production to
the properties described in the attached Schedule A.
TOGETHER with the non-exclusive right. if any, of the party of the first
part a~ to the use for ingress and egress of any streets and roads abutting
the described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estat~ and rights of
the party of the first part in and to said premises, insofar as the rights
granted hereunder are concerned
TO HAVE AND TO HOLD the said DEVELOPMENT RIGt:'iS herein
granted unto the party of the second part, its successor and assigns
forever.
AND the party of the first part covenants that the party of the first
part has riot done or suffered anything whereby the said premises have
been encumbered in any way whatever, except as aforesaid. The party
of the first part, as a covenant running with the land in perpetuity, further
covenants and agrees for the party of the first part, and its heirs, legal.
representatives, successors and assigns of the party of the first part, to use
the premises on and after the date of this instrument solely for the
purposes of agricultural production.

The definition of "Agricultural Production" as defined in Section 25-
30 of Chapter 25 of the South old Town Code is as follows.
Agricultural Production shall mean the production
for commercial purposes of crops, livestock and
livestock products, but not land or portions thereof
used for processing or retail merchandising of such
crops, livestock or livestock products. Land used in
agricultural production shall also include fences,
equipment storage buildings. livestock barns.
irrigation systems, and any other structures used
exclusively for agricultural purposes.
The party of the first part and the party of the second part do
hereby covenant and agpee in perpetuity that either of them or their

respective heirs. SUccE:.isors. legal representatives or assigns, shall only use
thu premises on and after this date for the purpose of such agricultural
production and the grantor covenants and agrees that the. underlying fee
title may not be subdivided into plots by the filing of a subdivision map
pursuant to Sections 265 and 277 of the Town Law and Section 335 of the
Real Property Law. or any of such sections of the Town or Real Property
Law or any laws replacing them or in furtherance of them.
The word "party" shall be construed as if it reads "parties" whenever
the sense of this indenture so requires.
The party of the first part covenants and agrees that it will (a) not
generate. store or dispose of hazardous substances on the premises. nor

allow others to do so; (b) comply with all Environmental Laws; (c) allow

The South old Town Planning Board, at a meeting held on Monday, March 12, 2007,
adopted the following resolution:
WHEREAS, this proposal is for a Conservation Subdivision of a 21.7837 -acre parcel
into two lots where Lot 1 is 10.6837 acres and has been acquired by the Town of
Southold for Open Space purposes, and Lot 2 is 11.1 acres upon which the
Development Rights have been sold to the Town of Southold; and
WHEREAS, on October 16, 2006, the Southold Town Planning Board granted final plat
approval upon the plat prepared by John T. Metzger, L.S. dated August 16, 2006 and
authorized the Chairperson to endorse the maps; and
WHEREAS, the Planning Board re-issued final approval on January 8, 2007 because
the time period in which to file the approved map expired; and
WHEREAS, due to a filing error with the County Clerk, the applicant was unable to file
the map within the 62-day time period and has again requested that the Planning Board
re-issue approval upon the plat prepared by John T. Metzger, L.S. dated August 16,
2006 and authorize the Chairperson to endorse the maps; be it therefore

RESOLVED, the South old Town Planning Board hereby re-issues final approval upon
the plat prepared by John T. Metzger, L.S. dated August 16, 2006 and authorizes the
Chairperson to endorse the maps.

DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION made this 7th day of May, 1986, by
CECIL T. YOUNG, residing at (no .) Main Road, Laurel, NY
11948, hereinafter referred to as the "Declarant";
WHEREAS, the Declarant is the owner in fee simple
of a certain parcel of land situate on the north side of
Main Road (N.Y.S. Route 25), Laurel, To~~ of Southold,
County of Suffolk, New York, being the premises described in
deed dated December 7, 1940, recorded in the Suffolk County
Clerk's Office in Liber 2150 at page 305, a metes and bounds
description of which is shown on Schedule A attached hereto
and made a part hereof, hereinafter referred to as the
"premises".
WHEREAS, the Declarant intends to subdivide said
premises into lots for residential purposes and desires to
subject said premises to certain conditions, covenants and
restrictions.
NOW, THEREFORE, the Declarant does hereby declare
that the aforesaid premises and every portion thereof is
hereby held and shall be conveyed subject to the conditions,
covenants and restrictions hereinafter set forth, and that
every purchaser of said premises or any portion thereof, by
the acceptance of a deed thereto, covenants and agrees that
the premises so purchased shall be held subject to the
covenants, conditions, and restrictions hereinafter set
forth.

ARTICLE I: Neither of the lots in the
aforesaid subdivision shall be further subdivided or its lot
lines changed in any manner at any future date without the
approval of the Planning Board of the Town of Southold.
ARTICLE II: Any subdivision of any part of this
tract in the future shall have a map of the subdivision
filed in in the Office of the Suffolk County Clerk.
ARTICLE III: All new or reconstructed driveways
on Main Road shall make an angle of at least 700 and
referably 900 with the Main Road.
ARTICLE IV: All new or reconstructed driveways
on Main Road shall have a turnaround provision, such as a T-
shaped shunt, so that a vehicle leaving a lot will not have
o back out into the traffic stream on the road.
ARTICLE V: All stormwater runoff resulting
from the development and improvement of this subdivision or
any of its lots shall be retained on the site by adequate
rainage structures so that it will not flow onto the right-
of-way of Main Road.
ARTICLE VI: No sanitary disposal facility shall
e constructed or be otherwise located within 100 feet of
he upland edge of the wetlands and the shoreline of Laurel
Lake.
ARTICLE VII: No stormwater runoff resulting from
the development and improvement of the subdivision or any of
its lots shall be discharged directly into Laurel Lake or
he freshwater wetlands within and adjacent to the property.

ARTICLE VIII: A conservation or scenic easement
having a minimum width of 50feet shall be established along
the shoreline of Laurel Lake and the upland edge of the
freshwater wetlands within and adjacent to the property to
insure that no development adverse to the aesthetic quality
of the shoreline will take place adjacent to these features.
The conservation or scenic easement shall also cover the
wetland areas within the property as well as the abutting 50
feet of upland.
IN WITNESS WHEREOF, the Declarant has hereby

Development Rights Easement
Dear Mr. Keil:
I would like to thank you for providing me with the survey I requested of the easement
area showing the concrete loading dock and trailer pit that you had installed on the former
Young property in Laurel.
Members of the Land Preservation Committee inspected the site on July 27, 2009.
Although the Land Preservation Committee was not notified of your intent to construct the
cement transport areas that are located within the easement area, and the concrete loading
dock that is partially located within the easement area, the committee members concluded
that the loading dock and transport areas are in use solely for agricultural production and, as
such, are acceptable uses within the easement area. The investigation revealed that no
easement violation was found.
