NY 11948 Re: Acquisition of Development Rights from Cecil & Marian Young Tax Map No. 1000-125-1-6.1 Dear Mr Lundstedt: I have reviewed your proposal that Mr Young retain a 25 foot wide easement to the wooded parcel in the back of his property with the Land Preservatlol'). Committee. While the committee believes it IS appropriate for Mr Youn,9 to retain access to that property. the proposed location of that access dc/,vn the center of the farm parcel is not acceptable. for the following reasons: . an accessway down the center of the farm parcel will make it more difficult to farm the parcel. . the proposed location of the road will consume nearly one-half acre of farmland. reducing the price which will be paid by the Town to Mr Young. . the length of the proposed accessway will make it very expensive to develop and maintain. The Town proposes that the accessway be located on the east side of the property Such location would marginally affect the farmland, have a mirllmal impact on the price of development rights being purchased, keep the road away from the Young residence and minimize the length of the accessway. . . . The land Preservation Committee has unanimously recommended we purchase the development rights of these two parcels. We think they will be very worthwhile additions to the portfolio of properties, that the Town has already preserved. The Young property is on the Main Road in Matti tuck, just west of the Town park, and the property abuts land on Laurel lake, so therefore the property will help protect laurel Lake in any encroaching development. The South old Town Planning Board, at a meeting held on Monday, March 12, 2007, adopted the following resolution: WHEREAS, this proposal is for a Conservation Subdivision of a 21.7837 -acre parcel into two lots where Lot 1 is 10.6837 acres and has been acquired by the Town of Southold for Open Space purposes, and Lot 2 is 11.1 acres upon which the Development Rights have been sold to the Town of Southold; and WHEREAS, on October 16, 2006, the Southold Town Planning Board granted final plat approval upon the plat prepared by John T. Metzger, L.S. dated August 16, 2006 and authorized the Chairperson to endorse the maps; and WHEREAS, the Planning Board re-issued final approval on January 8, 2007 because the time period in which to file the approved map expired; and WHEREAS, due to a filing error with the County Clerk, the applicant was unable to file the map within the 62-day time period and has again requested that the Planning Board re-issue approval upon the plat prepared by John T. Although the Land Preservation Committee was not notified of your intent to construct the cement transport areas that are located within the easement area, and the concrete loading dock that is partially located within the easement area, the committee members concluded that the loading dock and transport areas are in use solely for agricultural production and, as such, are acceptable uses within the easement area.
